Book excerpt: Il riordino della normativa sui servizi pubblici locali di rilevanza economica, disciplinato dal Decreto legislativo del 23 dicembre 2022, n. 201, ha l’obiettivo principale di stabilire principi comuni per garantire un elevato standard di qualità, sicurezza e accessibilità di tale tipologia di servizi pubblici. I servizi pubblici locali di rilevanza economica sono definiti come quei servizi forniti, o che potrebbero essere forniti, dietro compenso economico in un mercato, e che non verrebbero offerti senza un intervento pubblico o lo sarebbero con diverse condizioni in termini di accessibilità fisica ed economica, continuità, non discriminazione, qualità e sicurezza. Questi servizi sono previsti dalla legge o identificati dagli enti locali, nell'ambito delle loro competenze, come necessari per soddisfare i bisogni delle comunità locali, promuovendo così lo sviluppo omogeneo e la coesione sociale. Tra i servizi pubblici locali di rilevanza economica figurano quelli "a rete", che comprendono servizi economici generali di livello locale organizzabili tramite reti strutturali o collegamenti funzionali essenziali tra i punti di produzione o di erogazione del servizio, soggetti alla regolamentazione da parte di un'autorità indipendente. Tipici esempi di questi servizi a rete includono la distribuzione di energia elettrica, la distribuzione di gas naturale, il servizio idrico integrato, la gestione dei rifiuti urbani e il trasporto pubblico locale. Diversamente, i servizi “non a rete” comprendono, a titolo indicativo, impianti sportivi, parcheggi, servizi cimiteriali e funebri, se forniti come servizi pubblici locali, luci votive e trasporto scolastico. È evidente quindi il collegamento con il sistema degli appalti pubblici e altre norme speciali, specificamente previste dal legislatore per alcune tipologie di servizi. Da qui deriva la necessità di creare un quaderno operativo che, in modo agile, consenta di comprendere l’inquadramento generale della materia dei servizi pubblici locali a rilevanza economica e permetta allo stesso tempo una lettura delle norme sui servizi pubblici locali a rilevanza economica coordinata con la complessa disciplina in materia di contrattualistica pubblica. Il lavoro aprirà pertanto da una disamina dei principi generali che sorreggono la materia, passando per le varie modalità di affidamento dei servizi possibili, sino all’esame più specifico dell’affidamento degli impianti sportivi, tipico servizio pubblico locale oggetto, anch’esso, di una recente riforma normativa. Il lavoro si conclude poi con un approfondimento sugli aspetti di carattere economico-finanziario che devono essere considerati negli affidamenti dei servizi pubblici locali a rilevanza economica (PEF, convenienza economica nella scelta delle forme di gestione, allocazione dei rischi, ecc.).
