Plusieurs conflits peuvent résulter du choix du nom commercial, notamment avec l'evolution technologique et informatique . Nous avons abordé les différentes formes de transmission du nom commercial, qui ont subi une approche particulière après la consécration de la thèse de propriété sur le nom commercial. Après avoir défini juridiquement le nom commercial, nous avons abordé dans la seconde partie sa protection. Il s'agit de savoir si les moyens de protection propres aux noms commerciaux sont suffisants pour protéger sa propriété contre toutes les formes d'usurpation . Partant de ce fait nous avons abordé les moyens de protection de la propriété du nom commercial en France et au Liban.
