Le présent manuel a pour ambition de renouveler la présentation de la matière en ne raisonnant plus par rapport aux intérêts susceptibles d'être atteints (car la fonction de la peine n'est pas de défendre une valeur) mais par rapport à l'action ou à l'abstention de celui qu'il s'agit de punir. L'objectif est de revenir aux fondamentaux du droit pénal en identifiant les comportements susceptibles de troubler l'ordre public (et non un intérêt particulier) et en tentant d'en dresser une typologie. De façon rigoureuse et exhaustive, la plupart des infractions pénales sont envisagées ici dans l'interprétation la plus récente qu'en donne la Cour de cassation, sans jamais oublier les exigences constitutionnelles ou européennes qui gouvernent la matière pénale.
