Book excerpt: Social housing appears to offer a solution for the housing of poor and disadvantaged people. The French "right to housing" offers poor and disadvantaged citizens priority in social housing allocation, and even a legal action against the State to obtain a social home. Despite this, France is suffering a long-lasting housing crisis with disadvantaged people having particular difficulties of access, often despite the efforts of local housing actors. This situation is affected by the European Court of Human Rights and EU decisions limiting diverse national housing and rental policies. Between historic French revolutions and the modern riots, negotiated solutions to social dilemmas emerged. Despite progress in constitutional principles, complex local negotiations still ultimately determine who is housed. Local social landlords, mayors and employee and tenant representatives use their privileges to house their insiders: existing tenants, locals and employees, with rent insufficiently subsidized. ‘Insider Outsider’ theory is used for an economic analysis of exclusion in social housing allocation: its processes, institutional context, and stigmatizing effects. This highlights the spatial effects of nimbyism, excluding disadvantaged outsiders, and concentrating them in deprived areas. Simultaneously, urban regeneration reduced affordable housing stock and ‘social mix’ became a reason to refuse a social home. History, comparative law, economic theory and local interviews with housing actors give a detailed picture of what happens in and around French social housing allocation for an interdisciplinary housing policy audience. Constitutional principles appear in an unfamiliar guise as negotiating positions, with the "right to property" supporting landlords and the "right to housing" supporting tenants. French debates about the function of social landlords are echoed across Europe and reflected in European policies concerning rights, and the exclusion of disadvantaged minorities.

Book excerpt: **Please note this is an unedited paperback reprint of the hardback, originally published in 2003** The British system of universal development control celebrated its 50th anniversary in 1997. Remarkably, the system has survived more or less intact but the experience of the 1980s has left large questions unanswered about the relevance and effectiveness of the system. This book traces the history of the development control system in Britain from early modern times to the present day.

Book excerpt: This book provides an up-to-date interdisciplinary assessment of the accountability of executive power in different European States and at the European Union level. From a legal perspective, it wonders to what extent the forms of responsibility and accountability of executive power have evolved in terms of legal technique or framework. From a historical perspective, it looks at the evolution of responsibility paradigms. From a political science perspective, it examines responsibility and the expectations of European democracies in terms of authority and efficiency. The volume also has a quantitative aspect identifying, gathering and analysing statistical material on responsibility and accountability in current political regimes. The book will be a valuable resource for researchers, academics, and policy-makers in constitutional law and politics, public law, comparative law, comparative politics, legal history and government.

Available in PDF, EPUB and Kindle. Book excerpt: Sustainability Governance and Hierarchy provides a solid, theoretically and empirically grounded reflection on the concept of "sustainability governance". This idea has been growing in popularity in social science literature, as well as among decision-makers and governance actors, as it brings together two vast fields of study that have sometimes been dismissed as vague or ideologically loaded. In order to link the concepts of "sustainability" and "governance", the book is organized around the exploration of hierarchy issues, which often lie in the background of the existing literature but are not the focus of analysis. The chapters reflect ongoing controversies and dialogue between scientists with different theoretical and thematic backgrounds, who are all willing to participate in and contribute to a constructive effort to reach a more inclusive and more theoretically relevant stage for sustainability studies, being content with merely global analyses. The book is an innovative contribution to the hierarchy/non-hierarchy debate regarding governance arrangements in the field of sustainability and sustainability studies. This book will be of interest to advanced students and scholars focusing on governance issues, sustainability studies, environmental studies, as well as on the methodological aspects of the social sciences (economy, geography, law, philosophy, political science, sociology, urbanism and planning). This book is published with the support of the European Union, the European Regional Development Fund (ERDF) and the Upper Rhine Interreg V programme, as part of the "Upper Rhine Cluster for Sustainability Research" project.

Available in PDF, EPUB and Kindle. Book excerpt: The book focuses on the processes of urban restructuring, power relations and the political economy of touristic authenticity. Through an in-depth analysis of Marrakesh, Morroco, the book proposes a comprehensive analytic framework. It highlights the issues of (post)coloniality, ideology, heritage-commodification, subjectivity and counter-conduct in the shadow of global capitalism. It explores how power relations and political ecomomy have shaped the city of Marrakesh over the past few decades, formulating new subjectivities. It reveals how urban policy’s sole purpose is to boost tourism in the city, bringing into question the long-term resilience and success of tourism as an economic activity and a policy choice. This book considers how the well-being of city residents is submitted to such policies, conforming to certain forms of appropriation – of land, culture and memory. The example of Morocco helps us understand a phenomenon affecting many other cities internationally. This book will be valuable to academics and practitioners across disciplines, including geography, political science, urban planning and architecture.

Book excerpt: Now in its third edition, Introduction to Greek Law remains the sole comprehensive summary of Greek law in a language other than Greek. In twenty insightful chapters, written by some of the best authorities on Greek law in Greece and in the United States, this book provides both analysis and commentary on the various aspects of theory and practice in contemporary Greek law, concentrating on comparative law aspects and on differences with corresponding concepts in the Anglo-American system and in other European systems. The third edition covers all these areas of substantive law and legal practice and more: the Greek Constitution and its relation to international law and the European Union; structure and distribution of state powers; effect of EC directives; regulatory authorities and administrative action; judicial organization; intellectual property; corporations and partnerships; labor relations; arbitration; commercial and maritime law; local government; legal persons; contracts and torts; marriage, divorce, and filiation; succession; bankruptcy; choice of law and recognition and enforcement of foreign judgments; taxation; investment incentives; and, criminal law and procedure. Of special value is the attention to recent revisions of civil, commercial and procedural laws, particularly in the fields of conflict of laws, procedure, property, obligations, succession, and family law. Bibliographies accompany each chapter, and useful appendices include comprehensive lists of statutes, cases, and international conventions. Introduction to Greek Law has been well-received internationally in its earlier editions, and the third edition, with its thorough updates, is sure to be equally welcomed by practitioners and academics alike

The importance of the human, economic and social issues caused by the question of generations’ solidarities led the International Society of Family Law to choose this theme for its XVIth World Congress (Lyon, July 19-23rd 2011). More than 200 speakers from 50 countries studied these questions from the legal angle, but also philosophic, economic and anthropological. This work collects a part of these papers about two great issues: the child, as the center of family solidarities; and the support for elders by family. Phenomena such as increasing life expectancy, population urbanization, labor-market entry barriers, decline of traditional family patterns, mark in depth our contemporary world and involve old solidarity disappearance and new solidarity emergence, reshaping relations between generations while bringing up the problem of the fate of the most vulnerable: children, the sick, disabled, and especially elderly people. – What then is the role of families and communities in protecting these people? – What is the relationship between public and private solidarity? – What are the rights and freedoms of people placed by age, illness or disability in a dependence situation? These are the issues addressed by the authors of this book.

Chad’s financial system is highly dependent on oil and agriculture, since it is a low-income country. In structuring the financial sector, the soundness and performance, short-term vulnerabilities, and supervision and crisis management of the Chadian banking system have been discussed with an emphasis on insurance and pension plans. In this study, the important role of legal and judicial environment in accessing the financial system is also explained.
