Book excerpt: This draft Bill comprises three parts with four schedules, and it contains measures designed to facilitate more consistent, targeted and effective regulatory enforcement through a) the establishment of a statutory corporation, to be known as the Local Better Regulation Office (LBRO), in England and Wales; and b) the introduction of a new expanded framework for regulatory sanctions in the UK which will enable Ministers to confer on specified regulators new civil sanctioning powers, in relation to particular criminal offences, including fixed monetary penalties, discretionary requirements and enforcement undertakings. This draft Bill follows on from the recommendations of the Hampton Review 'Reducing administrative burdens: effective inspection and enforcement' published in March 2005 (information can be found at www.hm-treasury.gov.uk/budget/budget_05/other_documents/bud_bud05_hampton.cfm) and the Macrory Review 'Regulatory justice: making sanctions effective' published in November 2006 (information can be found at www.cabinetoffice.gov.uk/regulation/reviewing_regulation/penalties/index.asp).

This book was released on 2004 with total page 104 pages. Available in PDF, EPUB and Kindle. Book excerpt: The UK established the world's first animal welfare protection laws, with the passing of the Protection of Animals Act in 1911 which made it an offence to cause unnecessary suffering to any domestic or captive animal. This draft Bill, which extends to England and Wales, seeks to consolidate and modernise the legislation in line with current animal welfare standards, including the reforms undertaken in other countries such as New Zealand and Sweden. Amongst its provisions, which are grouped under 10 headings, the draft Bill seeks to: i) establish a duty of care to ensure the welfare of all kept animals, enabling animal welfare organisations to intervene where there is evidence an animal is being kept in conditions likely to lead to suffering, rather than having to wait for evidence that the animal has suffered abuse before legal action can be taken; ii) prohibit the sale of pets to children under 16; iii) end the practice of giving pets, including goldfish, as prizes, for example at funfairs; and iv) make offences of animal cruelty or keeping animals for fighting arrestable offences, with the maximum penalty leading to imprisonment upto 51 weeks or a fine of upto £20,000, or both. This publication contains the text of the draft Bill, explanatory notes and a regulatory impact assessment.

Book excerpt: This Draft Marine Bill (Cm. 7351, ISBN 9780101735124) contains the following: a policy paper; the draft Marine Bill and explanatory notes; an impact assessment. The Bill sets out the Government's approach to a number of marine related issues, including environmental protection of the coastal marine environment and the seas surrounding the coast as well as access to the coastal environment for recreation. The legislation set out in this Bill was originally proposed in "Sea Change", a Marine White Paper, published in March 2007 (Cm. 7047, ISBN 9780101704724). The White Paper itself had proposed a strategic system of marine planning to balance conservation, energy and resource needs, using the principle of sustainable development. The Draft proposals in this Bill puts the earlier proposals of the White Paper into a legislative framework, which includes: the creation of the Marine Management Organisation; deliverance of new marine planning systems, including establishing new powers to enable the Government to put in place a network of marine conservation zones to protect marine life; better licensing decisions for licensing activities in the seas; reforms to a range of marine, migratory and freshwater fisheries management arrangements; allow greater access to the English coast. Comments on the Draft Bill should be submitted in writing by 26 June 2008.

Available in PDF, EPUB and Kindle. Book excerpt: In this monograph, Aistė Mickonytė examines the compliance of the European anti-cartel enforcement procedure with the presumption of innocence under Article 6(2) of the European Convention on Human Rights (ECHR). The author maintains that the pursuit of manifestly severe punishment with insistence of the European Commission on administrative-level procedural safeguards is inconsistent with the robust standards of protection under the Convention. Arguing that EU anti-cartel procedure is criminal within the meaning of the Convention, this work considers this procedure in light of the core elements of the presumption of innocence such as the burden of proof and the principle of fault. The author zeroes in on the de facto automatic liability of parental companies for offences committed by their subsidiaries.

Book excerpt: This publication contains a consultation paper, draft Bill, explanatory notes and an impact assessment. The proposals in the draft Bill aim to give effect to: the Government's response to Sir Michael Pitt's review "Learning lessons from the 2007 floods" (http://archive.cabinetoffice.gov.uk/pittreview/thepittreview/final_report.html and http://www.defra.gov.uk/environ/fcd/floods07/Govtresptopitt.pdf); "Future water - the Government's water strategy for England (2008, Cm. 7319, ISBN 9780101731928); and to the flood and water aspects of the Welsh Assembly Government's "Environment strategy" and "Strategic policy position statement on water" (http://wales.gov.uk/topics/environmentcountryside). The proposals cover flood and coastal erosion risk management, including a strategic overview role for the Environment Agency and provision for a new local authority leadership role in local flood risk management. Other policies cover main river mapping, co-operation and sharing of information, sustainable drainage systems, Regional Flood Defence Committees, implementation of the EU Floods Directive and the Water Framework Directive, reservoir safety, surface water management plans and hosepipe bans. Two major independent reviews are also awaited: Martin Cave's review of competition and innovation in water markets and Anna Walker's review of charging and metering for household water and sewerage services. Their recommendations will have to be considered and could lead to further legislative proposals in this area.

Book excerpt: The Better Regulation Executive and government departments are not yet in a position to achieve value for money in their management of regulation. However, the Better Regulation Executive, created in 2005, and departments have developed important elements of a structured approach to achieving sustainable reductions in regulatory costs and have delivered significant benefits. Businesses generally recognise the purpose of regulation, but they believe that it can be unnecessarily burdensome, particularly on the smallest businesses. Businesses interviewed by the NAO typically have to consider as many as 60 regulations, governed by many different regulatory bodies. Businesses, particularly small and medium enterprises, are not clear on how to comply fully with regulation. The NAO found that departments are not communicating effectively with businesses about regulation. Businesses find it difficult to keep up with the extent of new regulation and changes to legislation. The Coalition Government's programme included several commitments to regulatory reform. Departments are currently conducting evaluations of their existing regulations, but they have not been taking a systematic approach and no overall attempt has been made to review the total number of regulations that businesses face. Furthermore, there is as yet no detailed plan for achieving the new Government's regulatory reform objectives. Departments do not routinely evaluate the impact on business of regulation once it has come into effect. They are, therefore, not in a good position to make adjustments to improve regulation in light of experience.

Available in PDF, EPUB and Kindle. Book excerpt: This book is a collection of chapters on corruption. It highlights the importance of corruption, transparency, and accountability and ways to deal with it. Understanding the types of corruption is very important to know how to deal with it. Types of corruption include bribery, lobbying, extortion, cronyism, nepotism, parochialism, patronage, influence peddling, graft, embezzlement, double-dealing, under-the-table transactions, manipulating elections, diverting funds, laundering money, and defrauding investors. Identifying corruption in all its forms requires analyzing the country and its political system and laws and rooting out the sources of corruption and the people behind it. Corruption and those participating in it must be identified to find ways to deal with it, including installing proper governance mechanisms with complete transparency and accountability for politicians, people in power, and/or citizens, as well as applying rules and holding those who infringe them accountable. This book provides a comprehensive overview of the many types of corruption and how to handle them.
