Book Synopsis Arbitration Under International Investment Agreements by : Katia Yannaca-Small
Download or read book Arbitration Under International Investment Agreements written by Katia Yannaca-Small and published by Oxford University Press. This book was released on 2010-04-07 with total page 790 pages. Available in PDF, EPUB and Kindle. Book excerpt: Investor-state arbitration is a relatively new dispute settlement mechanism that allows foreign investors the opportunity to seek redress for damages arising out of breaches of investment-related treaty obligations by the governments of host countries. Claims are submitted to independent, international arbitration tribunals, which are called upon to interpret the treaty at hand. Because of the public interest involved in these cases, the awards of these tribunals are subject to much scrutiny and debate. Thus, it has already generated hundreds of cases and created new legal disciplines, inspiring a continuous string of legal writings. This book provides a comprehensive analysis of the main issues that arise in investor-state arbitration. It accompanies the reader through the phases of such a procedure, starting with an examination of the instruments, which provide, in the overwhelming majority of the cases, the legal basis for the requests for such arbitration. It then continues with the launching of the arbitration procedure, followed by the analysis of the main jurisdictional and substantive issues that the tribunals are confronted with, and the review procedures, when there is a request for setting aside of the award. It finally looks at the post-award phase and concludes with a reflection on the role of precedent in investment arbitration. Arbitration under International Investment Agreements: a Guide to the Key Issues contains in one volume what everybody needs to know on this evolving topic. Calling on the most renowned experts in this field, private practitioners, academics, government and international organization officials, it describes the process in all its phases from A to Z, providing a comprehensive insight in the way investor-state arbitration works from the perspective of the main actors involved. Its analyses of all key aspects of the topic are pragmatic and reliable.
Book Synopsis Foreign State Immunity and Arbitration by : Dhisadee Chamlongrasdr
Download or read book Foreign State Immunity and Arbitration written by Dhisadee Chamlongrasdr and published by Cameron May. This book was released on 2007 with total page 433 pages. Available in PDF, EPUB and Kindle. Book excerpt: In State Immunity and Arbitration the author explores the limits of the concept of State Immunity as it relates to both jurisdiction and execution against state property in arbitration cases. The current scope of state immunity from jurisdiction is examined with reference to legislative and jurisprudential developments in the US and UK where the author finds evidence of a definite shift away from the traditional restrictive theory of state immunity. A similar survey of state practice relating to waiver, both express and implied, of immunity from jurisdiction and the relevant rules of arbitration institutions such as the ICC also illustrate a trend towards shrinking immunity.

Book excerpt: " The various developments and changes in the field of arbitration, coupled with the large sums and important issues which are so often at stake in them, mean that a new book providing a comprehensive overview on the topic from an authoritative source is not merely very welcome: it is positively needed by professionals involved in arbitration and their clients. It is hard to think of an organisation better qualified to sponsor such a book than the Chartered Institute of Arbitrators, with its enormous experience and authority in the field. It is also hard to conceive of a more impressive and well qualified group of contributors to such a book than the list of people who Julio CEsar Betancourt and Jason A. Crook have included in this volume. Based on advice from SAC and proposals by Members, the GFCM adopted: three Resolutions, including two related to the GFCM statistical framework and one on the use of the 40 mm square mesh size in the codend of trawlnets. The GFCM strengthened the mandate of CAQ and adopted a new set up and modus operandi for the subsidiary bodies of the Committee. The Commission decided to strengthen its activities in the Black Sea. It acknowledged the importance of the five regional projects supporting the activities of the Committees and endorsed a series of amendments to its Rules of Procedure. The Commission agreed on its programme of work and adopted its budget for 2007, including the establishment within the Secretariat of a post of Aquaculture specialist.
