This book was released on 2011-03-14 with total page 108 pages. Available in PDF, EPUB and Kindle. Book excerpt: The large majority of those claiming Jobseeker's Allowance make every effort to find work. But some customers do just enough to meet the conditions of their claim while at the same time continually failing to demonstrate the focus and discipline that is a key requirement of finding, securing and retaining employment. Mandatory Work Activity is being introduced to enable advisers to address this problem, supporting this particular group of customers at the earliest possible stage. But the Committee finds that published evidence is at best ambivalent about the chances of such 'workfare' type activity improving outcomes for people who are out of work. It is worried about the precedent set by appearing to punish claimants who are satisfying the conditionality rules (otherwise they would be subject to a sanction) but who, in the view of a Personal Adviser appear to display what is deemed to be the 'wrong attitude'. The Committee's key recommendation is that the introduction of this scheme should not continue. Its concerns cover the general principles of the proposals; the way participants will be selected; how placements will be structured and monitored; and the sanction regime attached. The Government, however, does not accept the Committee's recommendations or suggestion that the scheme is a punishment, and sets out its reasons for its position. The proposals are to go ahead.

Download or read book The Jobseeker's Allowance (Employment, Skills and Enterprise Scheme) Regulations 2011 (S.I.2011 No.917) written by Social Security Advisory Committee and published by The Stationery Office. This book was released on 2011-03-31 with total page 242 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Employment, Skills and Enterprise Scheme covers four initiatives: (i) Skill Conditionality aimed at improving take-up of help and support for those claimants with an identified skills need that is a barrier to them gaining and keeping employment; (ii) Service Academies will give pre-employment training and work experience leading to a guaranteed interview; (iii) the New Enterprise Allowance will promote self-employment under the guidance of a business mentor; (iv) the Work Programme will provide back to work support for a wide range of claimants. The Social Security Advisory Committee broadly welcomes the schemes, but believes they would be attractive to claimants without the sanctions-based conditionality attached to them. The Government does not agree with that key recommendation. Overall, the Government accepts or partially accepts ten, and rejects five, of the Committee's recommendations.

Book Synopsis Law in a Complex State by : Neville Harris

Available in PDF, EPUB and Kindle. Book excerpt: Approximately half of the total UK population are in receipt of one or more welfare benefits, giving rise to the largest single area of government expenditure. The law and structures of social security are highly complex, made more so by constant adjustments as government pursues its often conflicting economic, political and social policy objectives. This complexity is highly problematic. It contributes to errors in decision-making and to increased administrative costs and is seen as disempowering for citizens, thereby weakening enjoyment of a key social right. Current and previous administrations have committed to simplifying the benefits system. It is a specific objective of the Welfare Reform Act 2012, which provides for the introduction of Universal Credit in place of diverse benefits. However, it is unclear whether the reformed system will be either less complex legally or more accessible for citizens. This book seeks to explain how and why complexity in the modern welfare system has grown; to identify the different ways in which legal and associated administrative arrangements are classifiable as 'complex'; to discuss the effects of complexity on the system's administration and its wider implications for rights and the citizen-state relationship; and to consider the role that law can play in the simplification of schemes of welfare. While primarily focused on the UK welfare system it also provides analysis of relevant policies and experience in various other states.

Available in PDF, EPUB and Kindle. Book excerpt: This review, looking at disability employment support, and entitled "Getting in, staying in and getting on", seeks to ensure that disabled people have the opportunities and support needed to meet their employment aspirations. The focus of the review has set out a number of recommendations for employment support and the author has focused on three areas to promote this objective. (1) To set out the types of support that today's young disabled people will want in a future economy; (2) Enshrining the right to work objectives as set out in the UN Convention on the Rights of Persons with Disabilities; (3) To make a case for cross-Government work to unlock the big enablers of employment, that is "Getting in, staying in and getting on" , which includes raising the aspirations of what disabled people can achieve. For "getting in" this should include more disabled people doing apprenticeships, work experience and work placements; for "staying in" there should be better promotion for Access to Work for retension and for "getting on" there should be greater encouragement of disabled people in setting up businesses and gaining skills for career development. The publication is divided into 5 chapters, with appendices.

Available in PDF, EPUB and Kindle. Book excerpt: The idea that European welfare states are struggling to meet new social risks during a process of adaptation to a post-industrial setting has been an acknowledged theory in welfare state research for some time. The authors of this remarkable book have chosen to study a powerful indicator of how this trend might affect legal protection and access to justice for individuals: reforms in social security systems as they apply to cases of reduced earnings capacity. While previously the notion of social protection made welfare state inhabitants feel that the risk of loss of income due to physical or psychological hindrances was minimal, this sense of security can no longer be taken for granted. This book presents in-depth analyses, by nine leading scholars in social security law, of recent reforms in the field of incapacity benefits in four European countries: Germany, the United Kingdom, the Netherlands, and Sweden. The authors emphasize how recent reforms in the field of social security have been transformed into legal provisions, how the gate-keeping function is implemented in the legislation of the different countries, and to what extent the reforms have affected the legal position of the individuals concerned. They find that ever-tightening requirements designed to reduce benefit dependency, in combination with policies emphasizing individual responsibilities rather than individual rights, cause increased social risks for exposed groups. Among the specific aspects covered are the following: Measuring the reduction of earnings capacity; rights and obligations attached to reintegration into the labour market; work capability assessment procedures; "rehabilitation chains" with fixed time limits; the real and increased risk of poverty faced by long-term incapacitated persons; constitutional concerns raised by increased dependency on means-tested benefits; conditionality of benefits on work-related activities, participation in training programmes, or active job searching; and sanctions that can be applied if the claimant fails to comply with activation measures. All the country chapters provide thorough surveys of recent reforms, as well as analyses of their different weaknesses and strengths. The European dimension is explored with particular reference to anti-discrimination legislation, health and safety law as well as the Open Method of Coordination. As a systematic analysis of the current reforms relating to reduced earnings capacity, this book will attract a wide readership among lawyers and policymakers for its thorough coverage of the current landscape and the far-reaching implications it suggests. The book's systematic comparative method sheds a bright light on the challenges faced by post-industrial European welfare states, and its crystallization of the legal strategies behind the individual legal measures and reforms deepens our understanding of the institutions of social security and our awareness of the rights and obligations of exposed individuals.

Book Synopsis Universal Credit Implementation by : Great Britain: Parliament: House of Commons: Work and Pensions Committee

This book was released on 2012-11-22 with total page 222 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Universal Credit pilots (Pathfinders) will begin in the north west of England in April 2013 and full national roll-out is due to start in October 2013. The Government has designed a welfare system which should help ease the transition from benefits to work, but significant concerns remain about the potential impact of the changes on some of the most vulnerable benefit claimants, especially the online claims system and the proposed single monthly payment. The Government needs to reflect on its ambitious implementation timetable. Under Universal Credit, payments to cover the costs of rent will go to the benefit claimant, rather than direct to the landlord. This is a major change and the Committee therefore recommends that, during the initial phases of implementation, claimants who currently have their housing costs paid to their landlord should have the option to continue with this arrangement. The Committee also notes that it has not yet received sufficient evidence to satisfy itself that the Government will achieve its stated aim of ensuring more generous support for the disabled. The Government plans to calculate monthly Universal Credit payments by using information taken from data feeds from HMRC's new Real Time Information (RTI) system though there are concerns about that programme. The Committee, further, recognises that there is likely to be a significant increased demand for advice services during the four-year transition to Universal Credit. The report also comments on closely-related policy areas, including: the conditionality and sanctions regime; passported benefits; localisation of council tax support; localisation of the Social Fund
