Book excerpt: The UK established the world's first animal welfare protection laws, with the passing of the Protection of Animals Act in 1911 which made it an offence to cause unnecessary suffering to any domestic or captive animal. This draft Bill, which extends to England and Wales, seeks to consolidate and modernise the legislation in line with current animal welfare standards, including the reforms undertaken in other countries such as New Zealand and Sweden. Amongst its provisions, which are grouped under 10 headings, the draft Bill seeks to: i) establish a duty of care to ensure the welfare of all kept animals, enabling animal welfare organisations to intervene where there is evidence an animal is being kept in conditions likely to lead to suffering, rather than having to wait for evidence that the animal has suffered abuse before legal action can be taken; ii) prohibit the sale of pets to children under 16; iii) end the practice of giving pets, including goldfish, as prizes, for example at funfairs; and iv) make offences of animal cruelty or keeping animals for fighting arrestable offences, with the maximum penalty leading to imprisonment upto 51 weeks or a fine of upto £20,000, or both. This publication contains the text of the draft Bill, explanatory notes and a regulatory impact assessment.

Book excerpt: The Bill has two main purposes: to provide additional powers to tackle Foot and Mouth Disease (FMD) and for these powers to be extendable to other animal diseases by order; and to provide additional powers to deal with transmissible spongiform encephalopathies (TSEs) in sheep. The Bill supplements existing powers, under the Animal Health Act 1981, to slaughter animals to control the spread of FMD, by allowing animals to be slaughtered wherever this is necessary for disease control reasons. At present, only animals which are affected or suspected of being affected with the disease, have been in contact with affected animals, or exposed to the disease may be slaughtered. The Bill also alters the arrangements for compensation; and makes a number of amendments to enforcement provisions.

This report considers the Bill's compatibility with human rights concerns regarding: the imposition of criminal liability on those who refuse to assist an inspector when required to do so; inspection powers to enter premises under warrant without giving prior notice or obtaining the consent of the occupier to destroy animals; and the absence of a right to appeal against a decision to destroy animals before that decision is implemented. Overall, the Committee concludes that: the Bill provides a clear example of the need for the Government and Parliament, and those who ultimately will have responsibility for implementing its provisions, to strike a balance between the public interest and the rights of individuals; and that information on any decisions made should be presented to Parliament.
