Its spokesmen emphasized the catholic heritage in Protestantism and fostered the ecumenical hope of a reunion of Protestantism, Roman Catholicism, and Orthodoxy. They presented a high church sacramental conception, as opposed to the predominant revivalistic, individualistic, and sectarian habit of mind. The movement was generally disapproved as Romanizing and its popular influence was accordingly minimal. The two creative writers were John Williamson Nevin, the theologian, and Philip Schaff, the historian and liturgical scholar, who taught together at the college and seminary of the German Reformed Church at Mercersburg, Pennsylvania. Their books, tracts, and periodical articles had only a limited circulation and are no longer generally accessible, having been little regarded in the intervening years. The general stance of the Mercersburg men was parallel to that of the high church Lutherans of Germany and the Tractarians in the Church of England. The movement was the chief American counterpart to these developments, since the American Episcopalian disciples of the Tractarians could scarcely be compared to Nevin and Schaff in theological stature. The Americans were more philosophically oriented than the Anglo-Catholics, utilizing the concepts of Schelling and Hegel to interpret the classical doctrines of the Trinity and Incarnation and to define the relation of private judgment to Church tradition. They were also mediators to America of much of the mid-nineteenth-century German theological scholarship. The Americans were also more conscious than the Tractarians of the implications for theology of the new historical consciousness prevalent in Germany. Schaff set forth the idea of the historical development in the same year as Newman's famous essay on the subject. But while the conception undercut the Tractarian position for Newman, the Mercersburg theology was built upon a parallel view. The evangelical catholicism of Mercersburg was most widely influential through the liturgy produced under Schaff's leadership, which has maintained a limited local continuity to this day.

American Christians largely rejected any inherited philosophical discipline or categories, claiming the right to invent moral and religious reality without attention to Christian tradition. The paradoxical result was authoritarian rationalism: religious doctrines imitated scientific reasoning (“common-sense” philosophy) but were imposed by ecclesiastical fiat. In contrast, Nevin summoned his fellow theologians to pay fresh attention to the Idea: the rational unpacking of transcendent truths in being, moral right, and revelation. Part 2 then documents his criticism of the predominant Christian alternatives in the mid-nineteenth century. Such alternatives were deeply flawed, Nevin thought, as they necessitated that supernatural reality be experienced through an external authority demanding assent and obedience—the pope, a body of bishops, an authoritative Bible. But for Nevin, “supernature” is Jesus Christ himself who generates and sustains the reality of which the church speaks. Thus the highest Idea was Jesus Christ, now incarnate in the history and sacramental and liturgical life of the church.

Book excerpt: Within ecclesiastical circles, both from the perspective of legal practice and ordinary relational matters between ecclesiastical entities, the theme of contract very scarcely occupies a place of prominence. It is a situation that is due on the one hand, and to a large extent, to the fact that the canonisation of civil law on contracts (c. 1290 CIC/1983) has had the consequence of transferring the preoccupation of the entities on this matter to the domain of civil law. Besides, and still connected to the above, is the tendency to attribute a merely pastoral relevance to their relationships, with little or no reference to the juridic aspects inherent in these relationships. It is a situation that is largely responsible for the crisis which do not uncommonly characterise some of these relationships as verified over the centuries; particularly in the relationship between dioceses and religious institutes. The issuance of various papal and conciliar exhortations before and after Vatican II, as well as the normative instructions and legal provisions contained in various juridic documents, most prominently cc. 271, 520, 681 and 790 of CIC/1983, has gone a long way to dissipate some of the tensions of the past. However, the true nature of how the contractual relationship between ecclesiastical entities, including the attendant issues of conceptual understanding, civil status of ecclesiastical entities, resolution of contractual disputes, etc., remains a matter of investigative interest for the canonist. This is, in a nutshell, the substance of this research work. The conclusions arrived at offer the reader an insight into the available untapped resources within the ecclesiastical legal system, as well as some considerable possibilities which remain to be explored to the benefit of the subjects of canon law.
