Available in PDF, EPUB and Kindle. Book excerpt: This volume serves to provide an international overview of personal injury compensation in different geographical areas (15 countries already included), with a special focus on the methods used to ascertain the injury and the related damages. It also goes on to clarify the logical and methodological steps required for a sequential, in-depth ascertainment of any traumatic event and the related personal damage, both pecuniary and non-pecuniary. Personal injury is a legal term for an injury to the body, mind or emotions suffered by the plaintiff under tort and/or civil law regulations. Damages related to the injury can be pecuniary or non-pecuniary in nature. Although several comparative studies and research projects on tort and civil law and personal injury claims aimed at developing new tools for promoting harmonization of private law have been performed at an international level, heterogeneity and divergences still exist in the definition and compensation of personal injury and damage across different national legislative systems. The starting point for any awarding procedure should be a medical, or rather a medico-legal, assessment to gain evidence on the trauma or event causing the injury, the mechanism of injury, the pre-existing health status of the injured party, and the health consequences of the injury (temporary and permanent impairment, work incapacity, etc.). In order to pursue the ultimate goal of an international harmonization of personal injury compensation, it is of upmost importance to define the quality requirements for the medico-legal ascertainment methodology, which are essential for guaranteeing the objectivity, rigor, and reproducibility of the data and the evidence collection procedure. Currently, there are no supra-national medico-legal guidelines dealing with the ascertainment methodology of personal injury and damage under tort and civil law.

Book excerpt: There is a long history of inventing illness, such as pretending to be sick for attention or accusing others of being ill. This volume explores the art of illness, and the deceptions and truths around health and bodies, from a multiplicity of angles from antiquity to the present. The chapters, which are based on primary-source evidence ranging from antiquity to the late twentieth century, are divided into three sections. The first part explores how the idea of faking illness was understood and conceptualized across multiple fields, locations, and time periods. The second part uses case studies to emphasize the human element of those at the center of these narratives and how their behavior was shaped by societal attitudes. The third part investigates the development of regulations and laws governing malingering and malingerers. Altogether, they paint a picture of humans doing human actions—cheating, lying, stealing, but also hiding, surviving, working. This book’s careful, accessible scholarship is a valuable resource for academics, scientists, and the sophisticated undergraduate audience interested in malingering narratives throughout history.

Book excerpt: The book discusses compensation mechanisms and other non-judicial means that offer alternatives to court proceedings, designed and provided for within national legal regimes. Such schemes are primarily of a civil or administrative character and are mainly intended to supplement criminal liability for medical negligence. As such, the book focuses on medical malpractice and prospective medical harm from a civil law perspective. It examines the contemporary perspective of a patient-physician relationship, which has evolved from a relation of a quasi-patrimonial character into a partnership of quasi-equal parties, dealing with a medical treatment procedure as a scientific endeavor. It also reviews the extra-legal conditions that are taken into account in compensation arrangements, particularly the need to satisfy a psychological urge for conciliation and empathy on the part of medical personnel. Lastly, the book explores the responsibility of public authorities and healthcare providers to guarantee access to healthcare that is of a sufficient quality, based upon standards provided for in international (and European) law.

Available in PDF, EPUB and Kindle. Book excerpt: This book aims to analyse the legal tools that the legislatures of France, Germany and Italy adopted in order to regulate medical malpractice. In the mid-1970s, a reform movement started in the United States, where there was considerable concern about then ongoing medical malpractice crises. Since the beginning of the current century, France, Germany and Italy have passed statutes that aim to reform medical liability rules. Thus, it is first interesting to assess whether any medical malpractice crises have been identified in these systems and, second, how these have been faced through the passing of new statutes on the continent. Accordingly, the first chapter explores the idea of medical malpractice crisis and its relationship with the insurance market, also considering the reflections of American scholars. It then reconstructs the French, German and Italian legal frameworks, as well as their insurance and litigation contexts, reviewing and commenting on the quantitative evidence that was collected before the reforms. The second chapter briefly summarises the debate on medical malpractice reforms in France, Germany and Italy. It then analyses the statutes that have been passed, distinguishing between reforms that consolidate case law and reforms that introduce innovative solutions, sometimes repealing court-developed doctrines. In particular, the chapter examines in a comparative perspective the diff erent options adopted in these civil law countries with regard to the rules on liability, burden of proof, statute of limitations and damages. Moreover, the chapter examines the reforms of insurance, procedural and evidence law, to the extent they affect medical malpractice cases. The third chapter reviews and analyses the current available data related to medical malpractice litigation and insurance after the reforms adopted in France, Germany and Italy, in order to find out evidence of their effectiveness and efficiency. It also highlights some aspects of medical malpractice law that still belong to the domain of the judiciary. It finally points out which problems may be addressed by the legislatures and what further data should be collected in the future. This work may interest legal scholars, healthcare providers, insurers and policymakers.

This book was released on 2012-12-06 with total page 532 pages. Available in PDF, EPUB and Kindle. Book excerpt: Professor Patrice MANGIN President of the XVlth Congress of the International Academy of Legal Medicine and Social Medicine The International Academy of Legal Medicine and Social Medicine was founded in 1938 in Bonn. The motive for founding the Academy was to promote associating and confronting on an international background the scientific research work produced in the various domains dealing with the Legal and Social Medicine. As first presi dent of the International Academy of Legal Medicine and Social Medicine, Professor Knud Sand from Copenhagen, assisted by colleagues of the Praesidium appointed as national representatives, succeeded in gathering together nearly the whole aca demic people involved in Legal and Social Medicine. Thus one year later, in 1939, The Academy became a worldwide institution of 450 members from thirty nations. After the war, what had been before of considerable interest for the progress of the knowledge and techniques in Legal Medicine remained again a pressing necessity leading to the second meeting of the Academy in 1947 in Brussels under the presi dency of Professor De Laet. Since then the meetings of the Academy followed one another every three years. At this point, I would like to thank all the past presidents of the Academy and in particular Professor Roche and Professor Andre for their contribution without which the Academy would not be what it is presently.
