Book excerpt: Stalking is a distinctive form of criminal activity composed of a series of actions (rather than a single act) that taken individually might constitute legal behavior. In domestic situations, stalking typically occurs after the woman has attempted to leave the relationship. The man, unable to accept rejection, and unwilling to let the woman leave, begins to follow, threaten, harass, or assault her. The term "separation assault" has been coined to describe this behavior. This is the 1996 annual report providing information concerning the incidence of stalking and the effectiveness of State antistalking efforts and legislation.

Book excerpt: The Violence Against Women Act (VAWA), Title IV of the Violent Crime Control and Law Enforcement Act of 1994 (Public Law 103-322), improved our country's response to violence against women, including domestic violence, stalking, and sexual assault. VAWA and its recent reauthorization, the Violence Against Women Act of 2000, have transformed criminal and civil justice system efforts to address these serious crimes, bringing communities together to move forward to end violence against women. Police officers, prosecutors, victim advocates, and members of the judiciary are collaborating to leverage the coercive power of the criminal justice system to enhance victim safety and hold offenders accountable. To help support these initiatives, the U.S. Department of Justice, Office of Justice Programs (OJP), has provided tools and resources to implement coordinated community responses to violence against women and to fund basic research to expand understanding of stalking and domestic violence. This report to Congress is part of an ongoing commitment to share information about strategies that show promise in the field and about the development of laws addressing stalking. It is produced in response to Subtitle F of VAWA, which directs the U.S. Attorney General to submit a report on these issues. Our knowledge about domestic violence and stalking continues to grow as a result of innovative community-based strategies across the country. OJP is committed to addressing these problems aggressively on several fronts by providing resources to communities, supporting research to help understand and develop more effective responses to stalking, and increasing public awareness of these crimes, their consequences, and the resources available for victims. OJP's Violence Against Women Office is supporting the newly established National Resource Center on Stalking, which will collect information about promising antistalking practices and assist communities in adapting these to their needs. The National Institute of Justice continues to conduct research on effective strategies to combat violence against women, including domestic violence and stalking. State and Federal legislatures continue to pass legislation to hold stalkers accountable. Since enactment of State antistalking laws, the number of stalking cases reported to law enforcement has increased substantially. Similarly, Federal prosecutors are enforcing the Federal antistalking statute by bringing charges against stalkers in appropriate cases. These statutes and related prosecutions communicate the message that stalking is criminal and will not be tolerated.

Available in PDF, EPUB and Kindle. Book excerpt: Statistics show that there are currently 7.5 million victims of stalking in the United States each year. The year 2014 commemorated the 20th Anniversary since passage of the federal Violence Against Women Act of 1994 (“VAWA”) that was signed by President Bill Clinton on September 13, 1994. Passage of this Act marked a key transformation in our nation's response to the crimes of domestic violence, sexual assault, and stalking. The VAWA was established to promote “collaboration among law enforcement, health care providers, nonprofit service groups, community leaders, and the private sector” to combat these crimes. In fact, the VAWA was created as a “coordinated community response” to respond to the crimes of domestic violence, sexual assault, and stalking. In addition, this Act provided significant “federal resources for police, prosecutors, prevention programs, and victim service initiatives” in these cases. This Article highlights the serious problem of stalking and addresses whether after 20 years since the original passage of the federal VAWA in 1994, anti-stalking laws are effective at the local, state, and federal levels. Part II begins with a discussion of the VAWA. Part III includes statistics related to the incidences of stalking and its relationship to domestic violence as well as summarizes and provides a comprehensive analysis of state and federal anti-stalking laws in effect in 2014. Part III also contains an overview of the Model Anti-Stalking Code. Part IV discusses the various constitutional challenges that have been made in response to anti-stalking legislation and explains why such laws have and should be upheld. Part V evaluates the effectiveness of anti-stalking efforts at the local, state, and federal levels, discusses whether anti-stalking laws are effectively combating stalking, and emphasizes “model” anti-stalking laws that are being successfully utilized at the state level. Part VI concludes that anti-stalking laws are effective on their face, but provides recommendations regarding interventions, prevention efforts, and law enforcement practices to better protect victims of stalking. It also recommends that in order to make anti-stalking laws the most effective, there should be better identification of stalking offenses; increases in arrests, prosecutions, convictions, and sanctions imposed upon stalkers to exhibit the fact that stalkers will be held accountable for their conduct; and mandated professional counseling for stalkers.
