Pese a esa voluntad, el modelo anterior a la entrada en vigor de la Ley 41/2015, de 5 de octubre, de modificación de la Ley de Enjuiciamiento Criminal para la agilización de la justicia penal y el fortalecimiento de las garantías procesales, no permitía cumplir con dicha función. -- La Ley 41/2015 ha modificado sustancialmente el recurso de casación penal ampliando su ámbito, lo que ha permitido a la Sala Segunda del Tribunal Supremo pronunciarse sobre algunas de las figuras delictivas nuevas introducidas en el Código penal en las últimas reformas y sobre otros delitos que, si bien no han sido objeto de cambios, si venían siendo interpretados de manera dispar por las Audiencias Provinciales. -- Una de las materias que se han beneficiado de este recurso ha sido la seguridad vial. La Sala Segunda del Tribunal Supremo, en numerosas sentencias, ha conocido y resuelto determinadas cuestiones relacionadas con los delitos contra la seguridad vial unificando doctrina y poniendo fin a una indeseable dispersión interpretativa que daba lugar a resoluciones contradictorias. -- La presente obra aborda la respuesta del Tribunal Supremo a todas estas cuestiones con un planteamiento inicial de las dudas planteadas y la respuesta discrepante de las Audiencias Provinciales.

Taking into account changes in judicial and administrative practice as well as the Organisation for Economic Co-operation and Development’s (OECD’s) and the United Nation’s (UN’s) work in the three decades since the first edition, the present study brings the analysis up to date with the current internationally accepted interpretation of PE. The analysis is based on more than 720 cases from more than 20 countries, in addition to the OECD and UN model treaties and more than 630 books, articles, and official documents. The increased significance of the digital economy has rendered the traditional concept of PE inadequate for the allocation of taxing jurisdiction over the modern, mobile or digital international business. The author’s in-depth analysis explains the legal elements of the PE principle with attention to their continuing benefit and their shortcomings: criteria defining a PE- place of business, location, right of use, duration, business connection, business activity, ordinary course of business; evidence of a right of use to a place of business; business activities included in the PE concept of the tax treaties; identification of projects offshore and onshore; UN model treaty deviations from the OECD agency clause; distinction between jurisdictions with significant natural resources and countries possessing the capital, technology and know-how necessary to explore and exploit these resources; and how policies in each country may erode the PE concept. The book provides many synopses of court decisions and administrative rulings upon which the analysis is based. In addition to cases previously published in law reports and other publications, a number of unpublished decisions are included. A key word index makes it easy to find what is needed in any particular matter. The PE principle, in one version or another, is used in several thousand tax treaties in force today. This updated comprehensive study reveals the obligations imposed through the use of PE in tax treaties and will continue to be of immeasurable value to tax practitioners and scholars worldwide. Book excerpt: State and Institution Building in Ukraine represents the first in-depth and comprehensive study of state building in Ukraine. As opposed to previous books, which have focused on the political and economic transformation of the Soviet successor states, this volume argues that a market economy and democracy cannot exist in the absence of an effective state and governing institutions. Ukraine was only a quasi-state within the former USSR when it declared independence in August 1991, and thus it inherited only the rudiments of what is normally considered a "modern state." The development of a viable and capable state with effective institutions was prioritized by the executive and legislative branches who understood that a democracy, civil society, rule of law, and market economy could not be created in the absence of a genuine, functioning state. This study is the first to survey institution and state building in Ukraine by placing it within a comparative and theoretical perspective, challenging many of the current misconceptions about Ukraine and other post-Soviet countries.
