Book excerpt: Beginning in the 1960s, state legislatures across the country enacted consumer protection acts that “were originally designed to supplement the Federal Trade Commission's (FTC) mission of protecting consumers from 'unfair or deceptive acts or practices' and are referred to as 'Little-FTC Acts.'” As the area of consumer collection continues to grow in Florida, various healthcare providers are finding themselves subject to or threatened with a lawsuit for alleged violations of the Florida Consumer Collection Practices Act (FCCPA) and its federal counterpart, the Fair Debt Collection Practices Act (FDCPA), as well as the Telephone Consumer Protection Act (TCPA).Communications with patients--often sent in accordance with collection policies and procedures, patient agreements, form patient statements, dunning messages, and collection agency contracts--are becoming vehicles for consumer collection claims and exposing healthcare providers to liability. Healthcare providers should become familiar with Florida's consumer collection laws and implement strategies to increase compliance with and decrease exposure under the FCCPA, FDCPA, and the TCPA.

Available in PDF, EPUB and Kindle. Book excerpt: Doctor-patient relationship is a crux of medical care delivery infrastructure. It is based on in egalitarian notions where power and authority is vested with physicians. However, with the changes in socio-economic and politico-legal milieu this sacred covenant is altering. This appears to be true to the Indian situation. With the inclusion of medical services within the ambit of the Consumer Protection Act, patients are now entitled to approach consumer forums for redressed of their grievances. In general, medical professionals viewed it as a threat to their professional hegemony. Consumerism, Medicine and the Law looks at the changing doctor-patient relationship in India with special reference to the Consumer Protection Act. Medical negligence is from time immemorial, but due to the recent development in consumerism and human rights the cases become very typical regarding the fixation of liability and on what grounds, even if certain parameters have fixed it is very necessary that doctors must not in any way suffer their negligence in spite of remedy under different laws. The patients of medical negligence are still suffering and they need additional protection, especially the patients of government hospitals. The paper attempts to analyses a wide range of issues relating to medical doctor-patient relationship, medical negligence, the ethical and legal aspect of doctor-patient relationship, in the therapeutic encounter and the role of Consumer Protection Act vis-à-vis doctor-patient relationship from the perspectives of doctors and the patients. A few cases of medical negligence are also highlighted to draw the attention of healthcare consumerism in India.
Book Synopsis Medical Services and Consumer Protection in India by : Renu Sobti
Download or read book Medical Services and Consumer Protection in India written by Renu Sobti and published by . This book was released on 2001 with total page 342 pages. Available in PDF, EPUB and Kindle. Book excerpt: The enactment of the Consumer Protection Act, 1986 was a milestone in the history of socio-economic legislations in India. The Act was passed to create awareness among the people regarding their legal rights as consumers and to protect them against unfair trade practices. The Act was amended in 1991 and 1993 to extend its coverage and scope and to enhance the powers of the redressal machinery. The historic judgement of the National Consumer Disputes Redressal Commission (National Commission) in 1992 that medical services also constitute service under the Act, sparked off a country-wide controversy. Finally, the controversy was laid to rest when the Supreme Court (in the Indian Medical Association vs. V P Shantha case) held in 1995 that medical services are covered under the Consumer Protection Act, 1986. The judgement of the Supreme Court has wide implications for the patients as also for the doctors. This study is related to the investigation of patients' perception of medical services in India. It also examines the implications of the application of Consumer Protection Act, 1986 (CPA) to the medical services and its fall out on patient-doctor relationship. Furthermore, the study evaluates the approach of the redressal agencies under the Act in deciding cases relating to deficiency in medical services.

There are many books available for reference but this one is a handbook for practising doctors and their lawyers grappled with legal issues culminating in litigations covering a vast number of medical specialties and systems. This book proposes to fill the existing vacuum by creating authentic base required to understand the legal issues in medical practice in India. The esteemed contributors have put in their best efforts to share their knowledge, experience and wisdom with the readers by discussing various landmark legal decisions in the field of (alleged) medical negligence. It aims to make the medical practice safe, ethical, reassuring and hassle-free by discussing various legal issues related to medical practice.
