Il s’adresse à la fois aux juristes et aux non-juristes en proposant une analyse approfondie des solutions pratiques, illustrées par des exemples concrets fondés sur la législation et la jurisprudence luxembourgeoises. Selon les statistiques recueillies sur le terrain, de nombreux salariés s’estiment discriminés au travail. Pourtant, il existe une différence importante entre la notion intuitive de la discrimination et la notion légale, telle qu’elle figure dans le Code du Travail luxembourgeois. L’objet de cet ouvrage consiste à décrypter, à analyser et à expliquer cette notion légale et à détailler les moyens d’action et procédures permettant d’intervenir pour aboutir à une situation d’égalité exempte de discriminations. La discrimination est un sujet complexe et en permanente évolution. La loi recourt à des concepts difficiles à définir et à saisir ; la jurisprudence en la matière est par ailleurs peu fournie. De nombreuses questions restent donc ouvertes, et l’ouvrage vise à proposer des réponses en développant des raisonnements et arguments juridiques. Si à de nombreux égards, les problèmes de discrimination ne sont pas différents au Luxembourg de ceux qui existent à l’étranger, il en est autrement pour les aspects juridiques, le droit du travail luxembourgeois présentant certaines spécificités. A ce jour, il n’existait pas d’analyse de la discrimination focalisant sur le monde du travail, lacune que ce livre se propose de combler.
