Book excerpt: O trabalho intitulado “Apreciatividade e discricionariedade administrativa” busca demonstrar a existência de quatro, e não apenas três, formas de subjetividade ou autonomia pública. Além da liberdade de conformação ou configuração, a discricionariedade administrativa em sentido técnico-jurídico e a margem de livre apreciação dos conceitos jurídicos indeterminados, existe, também, o que se pretende chamar de apreciatividade administrativa. O trabalho expressa que a teoria das distintas margens de liberdade/autonomia/volição administrativa não aborda de maneira correta a existência de todas as condutas administrativas, ou seja, deixa de tratar da subjetividade ou da autonomia pública administrativa habilitada por fontes não voluntárias do Direito, derivada do conteúdo do Direito, dos defeitos do sistema jurídico e do exercício da função, reportando-se normalmente a ações não deônticas, realizadas por agentes públicos que atuam em contato direto com o cidadão, com algum caráter imediato ou urgente, e que são realizadas de maneira rotineira, regular e cotidiana. A proposta, portanto, é teorizar a apreciatividade administrativa. É por meio desse novo nomen iuris que se pretende estudar o alcance e o sentido da clássica discricionariedade, assim, demonstrando as analogias e diferenças dessa com este novo instituto. Para tanto, visualizam-se, inicialmente, as fases evolutivas e cronologicamente distintas das subjetividades/autonomias públicas na tomada de decisões fazendo uma incursão histórica sobre a matéria. Na continuidade, questionar-se-á o que são a discricionariedade administrativa e a margem de livre apreciação dos conceitos jurídicos indeterminados. Uma vez analisada a extensão de ditos conceitos, passar-se-á a estudar a apreciatividade como liberdade de atuação que opera como se tratasse de uma eleição/decisão, de um verdadeiro processo volitivo.

The law’s dependency on language, at least for the usual communication purposes, not only makes legal interpretation the main task performed by those whose work involves the law, but also an unavoidable step in the process of resolving a legal case. This task of decoding the words and sentences used by normative authorities while enacting norms, carried out in compliance with the principles and rules of the natural language adopted, is prone to all of the difficulties stemming from the uncertainty intrinsic to all linguistic conventions. In this context, seeking to determine whether legal interpretation can be scientific or, in other words, can comply with the requirements for scientific knowledge, becomes a central question. In fact, the coherent application of the law depends on a knowledge regarding the meaning of normative sentences that can be classified (at least) as being structured, systematically organized and tendentially objective.
