Book excerpt: Sono passati dieci anni dall’ultima edizione di questo volume e dunque una sua revisione era indubbiamente necessaria in considerazione del progredire continuo e costante delle relazioni tra gli Stati e conseguentemente del diritto internazionale. Crisi e guerre, interne ed anche internazionali, si sono succedute ed hanno posto gli Stati davanti a scelte e posizioni da prendere rispetto a determinate condotte (si pensi all’espansione dell’ISIS nei territori siriani ed iracheni o all’invasione della Crimea e poi dell’Ucraina da parte della Russia). Un’evidente recrudescenza dell’unilateralismo con venature imperialistiche da parte di taluni Stati sembra oggi mettere in crisi alcuni principi fondamentali della Comunità internazionale, quale il divieto di uso della forza armata e il divieto di ingerenza negli affari interni degli Stati. Alcune aree del pianeta vedono persecuzioni, discriminazioni e altre violazioni massicce e generalizzate dei diritti umani che troppo spesso, nonostante lo sdegno e la reazione della Comunità internazionale, continuano ad essere perpetrate. L’evoluzione tecnologica ha posto nuove sfide agli Stati; la digitalizzazione della società, ad esempio, li ha messi davanti alla questione della liceità degli attacchi cyber, nelle loro varie gradazioni, delle ingerenze negli affari interni, attraverso meccanismi di condizionamento che utilizzano i c.d. social, e delle modalità di reazione ad essi. In un decennio non facile per il multilateralismo, le Nazioni Unite hanno continuato a svolgere le loro funzioni, anche se, sul fronte del mantenimento della pace e della sicurezza internazionali, hanno segnato una battuta di arresto davanti a crisi come quella siriana e quella ucraina. L’impossibilità di attivazione del sistema di sicurezza collettiva a causa del diritto di veto dei membri permanenti ha un po' appannato l’immagine dell’Organizzazione che tuttavia nella sua azione quotidiana è sempre rimasta un punto di riferimento nella cooperazione internazionale e un foro di dialogo e di scambio di idee. In particolare, la Commissione di diritto internazionale delle Nazioni Unite ha continuato incessante la sua funzione di codificazione e sviluppo progressivo del diritto internazionale, inserendo nell’ordine del giorno dei suoi lavori lo studio di temi particolarmente spinosi come l’identificazione e le conseguenze giuridiche delle norme perentorie di diritto internazionale, l’identificazione del diritto consuetudinario, l’applicazione provvisoria dei trattati o il ruolo degli accordi successivi e della prassi successiva rispetto all’interpretazione dei trattati. Tribunali e corti internazionali sono stati investiti di molti casi, dalle controversie sulla sovranità o sulle delimitazioni marine a quelle attinenti al riarmo nucleare o alla tutela dell’ambiente dagli usi nocivi, senza considerare importanti pareri consultivi sui principi in materia ambientale e sull’au¬todeterminazione dei popoli. Sul fronte della giustizia penale internazionale, l’ultimo decennio è stato caratterizzato dalla fine delle attività dei Tribunali penali internazionali per la ex Jugoslavia e per il Ruanda con il passaggio del testimone alla Corte penale internazionale nella repressione delle violazioni massicce e generalizzate dei diritti umani. La giurisprudenza interna, segnatamente quella italiana, ha fornito contributi importanti sull’interpretazione del diritto internazionale e soprattutto sui rapporti tra diritto consuetudinario e principi fondamentali della Costituzione, portando alle estreme conseguenze quell’approccio dualistico tipico di una parte rilevante della dottrina. Nel presente volume sono stati dunque inseriti questi ed altri dati della prassi e della giurisprudenza e molti capitoli sono stati profondamente modificati rispetto alle precedenti edizioni. Ogni autore ha aggiornato e rivisto i capitoli di sua spettanza, che sono specificamente elencati nella prefazione alla Seconda edizione del volume alla quale si rinvia (supra p. XXV). Sfortunatamente nelle fasi conclusive della stesura del libro è mancato il Professor Leanza che teneva molto all’aggiornamento del testo. In qualche modo questo volume lascia, insieme a tanti altri suoi scritti, un ricordo della sua visione del diritto internazionale. Un diritto in continua evoluzione, non tanto nei tratti strutturali e nell’impianto normativo ma negli obiettivi, in progressiva espansione tanto da abbracciare non solo la promozione e protezione della sovranità statale in rapporto alle altre sovranità e la cooperazione tra le stesse ma anche la tutela dei diritti degli individui, singolarmente e collettivamente intesi. Infine, un sincero ringraziamento va al Dott. Francesco Gaudiosi, dottorando di ricerca nell’Università della Campania “Luigi Vanvitelli”, che ha collaborato all’aggiornamento delle parti bibliografiche e degli indici del volume.

Discussing imperative norms in PIL means referring to international public policy and overriding mandatory rules: in this book the origins, content, scope and effects of both these forms of imperativeness are analyzed in depth. This is a subject deserving further study, considering that very divergent opinions are still emerging within academia and case law regarding the differences between international public policy and overriding mandatory rules as well as with regard to their way of functioning. By using an approach mainly based on an analysis of the case law of the CJEU and of the courts of the various European countries, the book delves into the origin of imperativeness since Roman law, explains how imperative norms have evolved in the different conceptions of private international law, and clarifies the foundation of the differences between international public policy and overriding mandatory rules and how these concepts are used in EU Regulations on PIL (and in the practice related to these sources of law). Finally, the work discusses the influence of EU and public international law sources on the concept of imperativeness within the legal systems of European countries and whether a minimum content of imperativeness – mainly aimed at ensuring the protection of fundamental human rights in transnational relationships – between these countries has emerged. The book will prove an essential tool for academics with an interest in the analysis of these general concepts and practitioners having to deal with the functioning of imperative norms in litigation cases and in the drafting of international contracts.
