Book Synopsis Modern Forms of Work by : Stefano Bellomo
Download or read book Modern Forms of Work written by Stefano Bellomo and published by Sapienza Università Editrice. This book was released on 2020-10-06 with total page 284 pages. Available in PDF, EPUB and Kindle. Book excerpt: The collective volume “Modern Forms of Work. A European Comparative Study” evokes the intent to embody a reflection focused on modern labour law issues from a comparative perspective. A first set of essays contains national reports on modern forms of work. The second group contains some reflections regarding critical issues on digitalization, platforms and algorithms, analysing the different facets of the galaxy of digital work. The third group of essays flows into the section entitled “new balances and workers’ rights in the digital era”, a crucial topic in the debate. The complex of the writings, despite the diversity of approaches and methods, reveals the existence of a dense and inexhaustible dialogue between young scholars, at European and extra-European level. The analysis of new forms of work – the offspring of transnational processes of globalization and technologization – forms a fertile ground for experimenting a transnational dialogue on which young researchers can practice with excellent results, as this small volume confirms.

Book Synopsis Changing Industrial Relations & Modernisation of Labour Law by : Marco Biagi
Download or read book Changing Industrial Relations & Modernisation of Labour Law written by Marco Biagi and published by Kluwer Law International B.V.. This book was released on 2003-01-01 with total page 500 pages. Available in PDF, EPUB and Kindle. Book excerpt: Thirty-three distinguished authorities in the field of labour and industrial relations law gather here to enhance and complement the work of the late Marco Biagi, a man who, at the time of his violent and untimely death, had shown himself to be the most insightful and committed international scholar in this complex and controversial and, as it proved, even dangerous field. The topics covered range over many of Professor Biagi's special interests, including the following: the formulation of a new basis for labour law that could resolve new issues; employee protection in corporate restructuring; the trend toward individual 'enterprise bargaining'; a new European employment policy and what it might entail; the growing phenomenon of 'flexibilisation'; the effects of an aging workforce; the crucial nexus of free trade, labour, and human rights; the promise of EU enlargement; and protection of part-time workers. There is a lot of insight, innovation, and just clear thinking in this wide-ranging and far-reaching book. It will be of exceptional value to scholars, lawyers, and others concerned with the extensive and unpredictable changes under way in today's world of work.

Download or read book Selected Writings written by Marco Biagi and published by Kluwer Law International B.V.. This book was released on 2003-01-01 with total page 314 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Selected Papers in this volume, written over a period of some 20 years, represent just a small part of Marco Biagi's scientific writings, and are reprinted here with a view to showing the range, depth and originality of his research work. While many of his papers dealing with labour relations issues in the Italian context were published in Italian, Marco's long association with Johns Hopkins University and Dickinson College, along with his close links with the leading scholars in comparative labour law and industrial relations not just in the member states of the European Union, but also in many other countries, including Japan, were of fundamental importance for his work, and as a result he chose to publish many of his most thought-provoking papers in English. What emerges from a reading of these papers is the integrity and consistency of his thinking: themes that appear in his early work, such as industrial democracy, employee participation, training for flexibility, the role of small and medium-sized enterprises, and innovative strategies for creating new jobs and improving the quality of work, are further developed in the later years. He always wrote with a sharp eye on changes in the labour market arising from economic, social and political developments, such as most recently the introduction of the single currency, and always with a view to extending the benefits of employment opportunities beyond the existing limits. His ideas will continue to play an influential role in thinking about employment issues for many years to come.

Download or read book Capacitas written by Simon Deakin and published by Bloomsbury Publishing. This book was released on 2009-08-03 with total page 182 pages. Available in PDF, EPUB and Kindle. Book excerpt: One of the principal tasks for legal research at the beginning of the 21st century is to reconstruct the understanding of the relationship between the legal system and the market order. After almost three decades of deregulation driven by a belief in the self-equilibrating properties of the market, the financial crisis of 2008 has reminded everyone of the fundamental truth that markets have legal and institutional foundations, without which they cannot effectively function. The chapters in the present volume are the result of work by a group of legal scholars which began in the mid-2000s, at a time when the shortcomings of deregulatory policies were becoming clear in a number of contexts. The chapters address the question of how the language of contract law describes or conceptualises the market order and the relationship of the law to it. The perspectives taken are, in turn, historical, comparative, and context-specific. The focus of the book is on a foundational idea, the concept of capacitas, which signifies a status conferred upon citizens for the purpose of enabling them to participate in the economic life of the polity. In modern legal systems, 'capacity' is the principal juridical mechanism by which individuals and entities are empowered to enter into legally binding agreements and, more generally, to arrange their affairs using the instruments of private law. Legal capacity is thereby the gateway to involvement in the operations of a market economy.
