Trata-se de uma pesquisa teórica que tem como eixo a discussão sobre a coerência do conceito dos direitos políticos e da democracia à luz dos direitos humanos internacionais. Para os fins desta pesquisa, tornou-se necessário associar os direitos políticos e a democracia, uma vez que esses temas se encontram imbricados. Na vasta gramática dos direitos humanos, optamos pelos direitos políticos, por considerá-los estratégicos sob a perspectiva da efetivação daqueles. Na medida em que os direitos políticos caminham como meio para a consolidação da democracia, abre-se a possibilidade de efetivação dos direitos humanos nos Estados Democráticos. Percebemos que regimes políticos hegemônicos fechados não propiciam um ambiente favorável à concretização e à efetivação dos direitos humanos. Pelo contrário: estes são sistematicamente violados, como ocorreu em vários países ao se submeterem aos regimes autoritários. Os direitos políticos como estratégia, a democracia como regra procedimental e a legitimidade, que significa a inclusão do povo no processo de elaboração da vontade do Estado, em essência, formam uma estrutura sólida para o desenvolvimento dos direitos humanos e a consolidação do regime democrático. Posto, então, que a premissa determinante para a estabilidade política é a consolidação do regime democrático, este trabalho propõe-se a responder a seguinte questão: seria a democracia um valor universal?

Bringing together legal scholars from the Global South and the Global North, it examines these questions in the context of national, transnational and international law, within single and plural legal systems, and across a range of sector-specific issue areas. The chapters identify how traditional legal disciplines (e.g. constitutional law, consumer law, public procurement, international public law), sector-related regulation (e.g. energy, water, waste), and legal rules in specific areas (e.g. eco-labelling and packing) engage with the concept of sustainable consumption. A number of the contributions describe this relationship by isolating a national legal system, while others approach it from the vantage point of legal pluralism, exploring the conflicts and convergences of rules between multiple international treaties (or guidelines) and those between the rules of international and transnational law (or both) vis-à-vis national legal systems. While sustainable consumption is recognised as an important field of interdisciplinary research linking virtually all social science disciplines, legal scholarship, in contrast, has neglected the importance of the field of sustainable consumption to the law. Based on raw electoral data from 30 sub-Saharan African countries observed between 1966 and 2016, this text explores the causes and mechanisms of Party System Institutionalization (PSI) and its relationship with the processes of mobilization and democratization. Posing key theoretical and empirical questions in cross-regional comparison, it examines and reveals the defining properties of PSI, how they should be measured and under what conditions it varies. In doing so, it contributes with a new explanatory framework of party system development – that gives primacy to modes of transition, political institutions and party-citizen linkages – to further cross-regional comparisons among third-wave party systems.
