A legislação brasileira sofreu influência do Direito penal do inimigo, como se poderá constatar no quadro relacionando as características do referido Direito Penal com os dispositivos das Leis Nacionais. A Lei no 13.260/16, a qual tipifica o crime de terrorismo, regulamentando o Art. 5o, XLIII, da Constituição Federal, sofreu muitas críticas relacionadas à imprecisão de seus dispositivos.
