A legislação brasileira sofreu influência do Direito penal do inimigo, como se poderá constatar no quadro relacionando as características do referido Direito Penal com os dispositivos das Leis Nacionais. A Lei no 13.260/16, a qual tipifica o crime de terrorismo, regulamentando o Art. 5o, XLIII, da Constituição Federal, sofreu muitas críticas relacionadas à imprecisão de seus dispositivos. O conceito do garantismo, de Luigi Ferrajoli, e do Estado Democrático de Direito, de Norberto Bobbio, são importantes definições diante das perspectivas da democracia, assim como o Estado de direito frente às novas tecnologias do século XXI e o combate ao terrorismo dentro do Estado Democrático de Direito.

Their continued use and abuse reflect a much larger and troubling pattern: policymakers and the media naively or deliberately accept highly politicized and questionable statistical claims about activities that are extremely difficult to measure. So the question is what choices are available to the newly installed government whenconfronting the evils of the past. There are a wide array of transitional mechanismsto choose from, but there is no “one size fits all” mechanism.
