Consapevole di questo primato, il ministro e filosofo Giovanni Gentile nel 1923 inserì l’insegnamento della storia dell’arte nei licei classici: questo preveggente provvedimento, benché in seguito formalmente esteso alle altre scuole, nel corso dei decenni è stato nella sostanza lentamente eroso e annacquato, malgrado dall’arte l’Italia tragga un fiume di turisti e moneta pregiata. E la sensibilità generale sull’importanza di una simile conoscenza è talmente cresciuta che, per esempio in Francia, tra i programmi del presidente Sarkozy è previsto l’inserimento della disciplina nelle scuole di ogni ordine e grado. È dunque quanto mai cruciale che la Bella Italia metta a frutto il proprio vantaggio in questo ambito, che va dunque esaltato e non svilito, come avviene da troppi decenni.

Its main focus (like that of Volume 9) is on the ways in which jurists and legal philosophers thought about law and legal reasoning. The volume begins with a discussion of the ‘common law mind’ as it evolved in late medieval and early modern England. It goes on to examine the different jurisprudential traditions which developed in England and the United States, showing that while Coke’s vision of the common law continued to exert a strong influence on American jurists, in England a more positivist approach took root, which found its fullest articulation in the work of Bentham and Austin.
