Book excerpt: This comprehensive volume provides uniquely diverse insights into various aspects of decentralization and development from both developed and developing countries, with special reference to Sri Lanka. For a quarter century, Sri Lanka was battered by its prolonged civil war, which ended in 2009, but has now achieved relative peace and stability. Having developed rapidly, Sri Lanka offers a classic example for developing countries. There is, however, a strong need, particularly in the context of postwar conflict, to formulate policies for reconciliation, peace building, and development at all levels—local, provincial, and national. Decentralization itself is not a new subject; however, how to devolve power to local administrative levels within a unitary system and how to link the devolved power to make local administrative systems more conducive to development and provide better services for citizens are challenging tasks in many countries. Taking into account the developmental, governance, and conciliatory needs and the sensitivity of central–local relations, this volume critically examines the local government systems in Sri Lanka. It also proposes a viable, effective and autonomous local-level administrative unit based, which draws on experiences from Japan and other countries, and identifies the role and functions of such a unit. The book presents commissioned papers from a three-year research project undertaken by internationally respected experts with financial support by the Japan Society for the Promotion of Science (JSPS) under a Grant-in-Aid for Scientific Research.

Available in PDF, EPUB and Kindle. Book excerpt: This study argues that political Buddhism and Sinhalese Buddhist nationalism have contributed to a nationalist ideology that has been used to expand and perpetuate Sinhalese Buddhist supremacy within a unitary Sri Lankan state; create laws, rules, and structures that institutionalize such supremacy; and attack those who disagree with this agenda as enemies of the state. The nationalist ideology is influenced by Sinhalese Buddhist mytho-history that was deployed by monks and politics in the late nineteenth and twentieth centuries to assert that Sri Lanka is the designated sanctuary for Theravada Buddhism, belongs to Sinhalese Buddhists, and Tamils and others live there only due to Sinhalese Buddhist sufferance. This ideology has enabled majority superordination, minority subordination, and a separatist war waged by the Liberation Tigers of Tamil Eelam (LTTE). The study suggests both LTTE terrorism and the ethnocentric nature of the Sri Lankan state, which resorts to its own forms of terrorism when fighting the civil war, need to be overcome if the island is to become a liberal democracy. The present government of President Mahinda Rajapakse is the first to fully embrace the Sinhalese Buddhist nationalist ideology, suggesting that a political solution to Sri Lanka's ethnic conflict is unlikely. Meaningful devolution of power, whereby Tamils could coalesce with their ethnic counterparts amidst equality and self-respect, is not in the offing. A solution along federal lines is especially unlikely. Instead, continued war and even attacks on Christians and Muslims seem to be in store for Sri Lanka as the Sinhalese Buddhist nationalist ideology is further consolidated. The study recommends that the international community adopt a more proactive stance in promoting a plural state and society in Sri Lanka. In addition to countering the terrorist methods employed by the LTTE, the international community should initiate and support measures to protect fundamental civil liberties and human rights of Sri Lanka's ethnic and religious minority communities.

Available in PDF, EPUB and Kindle. Book excerpt: This book explains devolution today in terms of the evolution of past structures of government in the component parts of the United Kingdom. Available in paperback for the first time, it highlights the importance of the English dimension and the role that England’s territorial politics played in constitutional debates. Similarities and differences between how the components of the UK were governed are described. It argues that the UK should be understood now, even more than pre-devolution, as a state of distinct unions, each with its own deeply rooted past and trajectory. Using previously unpublished primary material, as well as a wealth of secondary work, the book offers a comprehensive account of the territorial constitution of the UK from the early twentieth century through to the operation of the new devolved system of government.

Available in PDF, EPUB and Kindle. Book excerpt: Nations built on exclusion and assimilation, decades of civil war, widespread poverty, authoritarianism and the decline of democracy. Nepal, Myanmar and Sri Lanka are travelling a road to federalism. Institutions and ethnic identity have interacted to privilege some and marginalise others. But when the right conditions prevail, political equality can be restored. This book charts the origins and evolution of federalism and other approaches to the accommodation of minority ethnic groups in Nepal, Myanmar and Sri Lanka. It applies a historical institutionalism methodology to understand why federalism has been resisted, what causes it to be established and what design options are most likely to balance otherwise competing centripetal and centrifugal forces. Breen shows how Nepal, Myanmar and Sri Lanka are finding a middle ground whereby deliberative and moderating institutions are combined with accommodating ones to support a political equality among groups and individuals.

Book excerpt: 'After the Fall' shows how Sri Lankas post-independence exercise in nation formation was beset with using language domination as an instrument of partisan power and racial memories as the way to define nationhood. That resulted in an escalating conflict through half a century of ethnic violence - giving rise to one of the worlds most fearsome militant movements and the cult of the suicide bomber. It analyzes how Eelam war four (20069), which came like a tornado crashing through all the red-lines of a war (even a guerrilla war), succeeded - and at what cost and consequences.

Book excerpt: This collection of essays surveys the full range of challenges that territorial conflicts pose for constitution-making processes and constitutional design. It provides seventeen in-depth case studies of countries going through periods of intense constitutional engagement in a variety of contexts: small distinct territories, bi-communal countries, highly diverse countries with many politically salient regions, and countries where territorial politics is important but secondary to other bases for political mobilization. Specific examples are drawn from Iraq, Kenya, Cyprus, Nigeria, South Africa, Sri Lanka, the UK (Scotland), Ukraine, Bolivia, India, Spain, Yemen, Nepal, Ethiopia, Indonesia (Aceh), the Philippines (Mindanao), and Bosnia-Herzegovina. While the volume draws significant normative conclusions, it is based on a realist view of the complexity of territorial and other political cleavages (the country's "political geometry"), and the power configurations that lead into periods of constitutional engagement. Thematic chapters on constitution-making processes and constitutional design draw original conclusions from the comparative analysis of the case studies and relate these to the existing literature, both in political science and comparative constitutional law. This volume is essential reading for scholars of federalism, consociational power-sharing arrangements, asymmetrical devolution, and devolution more generally. The combination of in-depth case studies and broad thematic analysis allows for analytical and normative conclusions that will be of major relevance to practitioners and advisors engaged in constitutional design.

Available in PDF, EPUB and Kindle. Book excerpt: Among the examples of civil wars, armed secessionist movements and minority uprisings in the world today, many involve conflict between a minority group’s aim for political self-determination, and the nation state’s resistance to any diminution of sovereignty. With the expansion of the international regime of human rights, minority groups have reconceptualised their struggle with the understanding that a minority which is linguistically, religiously or ethnically distinctive is entitled to self-determination if their aspirations cannot be met. This book explores the relationship between minority rights, self-determination and secession within international law, by contextualising these issues in a detailed case study of the rise of Tamil separatism in Sri Lanka. Welhengama and Pillay show how Tamil communalism hardened into secession and assess whether the Sri Lankan government has met its obligations with respect to the right to self-determination short of secession. Focusing on the legal and human rights arguments for secession by the Tamil community of the North and East of Sri Lanka, the book demonstrates how the language of international law and international human rights played a major role in the development of the arguments for secession. Through a close examination of the case of the Tamil’s secessionist movement the book presents valuable insights into why modern nation states find themselves threatened by separatist claims and bids for independence based on ethnicity.
