Book excerpt: Nowadays we are fortunate enough to be experiencing a boom in human rights - an enormous increase of their importance in the international sphere at all levels (political, economic, social, legal and moral). For the first time the condition of the individual as “citizen,” and not just as “subject,” has gained importance. Individuals, and not only states, have now become the subjects of international law, as a result of the boom in humanitarian law and international criminal law. However, although there have been many battles won and goals met concerning human rights, the war against injustice continues and the fight has not ended. It is necessary to stay alert and to avoid a potentially paralyzing self-complacency. This collection focusses on topics that are particularly relevant for the present era. It examines issues such as multiculturalism, globalization, international criminal justice (specifically third and fourth generation rights) and, within this thematic framework, the problems that have come about as a result of the expanding reach of the Internet and of new biomedical advances. In addition, it explores the increasingly urgent challenge of how to respond to international terrorism, in view of worldwide events since September 11, 2001, and its resulting aftermath. Originally published in Spanish, this thought-provoking collection will be of interest to human rights scholars and practitioners alike.

Mediante un análisis histórico y conceptual sobre la construcción del derecho humano a defender derechos humanos, así como de un encuadre sobre el marco obligacional del Estado respecto del mismo, este trabajo desarrolla un conjunto de indicadores que, basado en la metodología de desagregación o desempaque de los derechos, consiste en un original aporte a la sistematización de las distintas perspectivas metodológicas relacionadas con el uso de indicadores para el monitoreo y seguimiento de ese derecho, y en un valioso insumo que facilita su investigación.

Book excerpt: En términos normativos, resulta evidente que en los últimos 20 años se han producido avances de importancia en el derecho internacional de los derechos humanos. Se han adoptado una serie de nuevos instrumentos, incluyendo tratados, protocolos adicionales que refuerzan tratados previos, declaraciones y resoluciones. Son también relevantes las transformaciones a nivel institucional, entre las que resalta la creación del Alto Comisionado de Derechos Humanos y de la Corte Penal Internacional, el acceso directo para las víctimas al Tribunal Europeo de Derechos Humanos y el establecimiento de la Corte Africana de Derechos Humanos y de los Pueblos, así como la creación de algunos mecanismos producto de los nuevos tratados, especialmente en la Organización de las Naciones Unidas. A nivel regional este fortalecimiento también ha tenido lugar, destacando particularmente al respecto el desarrollo en el Sistema Interamericano de Derechos Humanos, a través de la jurisprudencia de la Corte y la Comisión Interamericana. Si bien los problemas en materia de eficacia de los estándares internacionales de derechos humanos se han vuelto más patentes, esto no quiere decir que la eficacia sea menor que en el pasado, sino que el fortalecimiento de los estándares internacionales y la difusión de los mismos no han ido de la mano con un mejoramiento de la misma magnitud en su implementación. Ello representa un problema de importancia distinto al que se vivía en el pasado, pero serio sin lugar a dudas, al crearse expectativas en la ciudadanía de los países que no son satisfechas adecuadamente. Tomando como base la situación actual, el libro que se presenta destaca la relevancia de mantener en alto la concepción de los derechos humanos, de reforzar su consagración a nivel internacional e interno y de fortalecer su eficacia a través de mecanismos operativos. Este es el gran desafío para las organizaciones internacionales, para los Estados y para la sociedad civil.
