América Latina es una de las regiones que reportan un alto consumo de bebidas azucaradas y productos ultraprocesados en el mundo, lo que hace a su población más vulnerable frente a enfermedades no transmisibles (ENTs). Con el fin de promover ambientes alimentarios y hábitos de consumo más saludables, la OMS y OPS han recomendado a los Estados que adopten un conjunto de medidas dentro de las que se encuentra la adopción de un etiquetado nutricional de advertencia basado en la mejor evidencia científica disponible. Distintos países de la región como Chile, México y Perú han adoptado el modelo de sellos de advertencia octagonal, el cual ha mostrado, además, su efectividad. Sin embargo, su adopción en estos y otros países de la región no ha sido fácil. La industria de ultraprocesados comestibles se ha opuesto a este modelo con argumentos que van desde lo económico, lo político y, también, lo jurídico. Frecuentemente ha argumentado que esta medida vulnera los acuerdos internacionales en materia económica pese a que la normativa internacional permite excepciones legítimas en favor de la salud pública. Esta publicación busca aportar al debate sobre la adopción de un etiquetado nutricional desde dos perspectivas. De una lado, desde una perspectiva legal, los autores reflexionan sobre los principales argumentos que se exponen en contra de esta medida de salud pública y aportan argumentos del derecho internacional para contestarlos; de otro lado, desde una perspectiva vivencial, los autores ofrecen un recuento de cómo lograron impulsar esta política de salud pública en sus países y cómo sortearon la oposición a esta. El libro es una reflexión desde el Sur Global hacia el mundo, sobre el etiquetado frontal de advertencia: una de las políticas de prevención de obesidad más importantes de los últimos años. Un libro para académicos, activistas y estudiosos de las interacciones entre salud pública, derecho y comercio internacional.

Este texto busca indagar sobre estas y otras preguntas desde un análisis jurídico de derechos humanos y desde la evidencia científica. En él se documenta por qué el etiquetado de alimentos es una herramienta de conocimiento importante para ejercer nuestros derechos y se discute qué está haciendo Colombia al respecto. Por último, se exploran los modelos de etiquetado implementados en México, Ecuador y Chile, evaluando desde la evidencia su efectividad. El documento muestra que los esfuerzos del Estado colombiano por establecer un etiquetado de alimentos claro, visible y veraz, no han sido suficientes. Además, hace una invitación explícita a los tomadores de decisión a nivel nacional para que regulen el actual modelo de etiquetado, cumpliendo sus deberes internacionales y constitucionales, y previniendo, así, el incremento de la obesidad en el país, particularmente de los niños, las niñas y los adolescentes.

While some businesses are relaying on their corporate website to make the sale, both traditional brick-and-mortar and new disruptive business models are increasingly using online marketplaces to offer their products online. European Union law has been gradually updated to reflect this new reality, with Intellectual Property Rights legislation and Consumer Law leading the way toward a suitable regulatory framework in the Platform Economy. However, the EU has not devised a comprehensive strategy for tackling the challenges posed by the online sale of physical consumer goods, such as effective public enforcement in online environments. In fact, sector-specific legislation, including Food Law, largely ignores online transactions.
