Il est un concept purement quantitatif, comptable, avec un point de départ et un point d'arrivée, entre lesquels s'écoule une durée. De très nombreuses quantités de temps, définies de manière abstraite ou concrète, arithmétique ou floue, parsèment le sol procédural, et notamment la phase de mise en état des affaires pénales. Cependant, il convient de ne pas s'arrêter à la seule dimension technique du délai. En effet, sa fonction est directement opposée à sa nature quantitative. Elle est de protéger la qualité du temps des procédures, c'est à dire la justification, la nécessité de ce temps aux buts légitimes de la justice pénale. Spécialement à la phase de mise en état, la qualité du temps est un instrument capital de l'équilibre procédural. La problématique temporelle de cette phase se résume à un tiraillement, un antagonisme extrême entre lenteur et rapidité convoitées par les divers intervenants au procès pénal. La recherche du " juste rythme " s'inscrit dans une perspective qualitative et non quantitative de la durée du procès pénal. Car il y a une lenteur paralysante et une rapidité escamoteuse d'une " bonne " justice. La qualité du temps procédural détermine celle de notre justice. On perçoit alors tout l'enjeu de parvenir à concilier les deux mouvements opposés du temps. Le délai est un rouage clé de l'équilibre procédural et sa ratio legis en fait un instrument de la célérité de la procédure. Ce concept qui est dans l'air du temps, est un autre nom de cette notion de qualité. En effet, la célérité ne doit pas être réduite à sa seule racine latine qui signifie " rapidité ". Les dictionnaires actuels renvoient au mot " diligence ", lequel désigne le soin mis à accomplir son travail, ce qui renvoie à une idée de qualité et non de quantité. Le principe de célérité, contenu en filigrane dans la Convention européenne des droits de l'homme, s'entend donc de l'emploi justifié du temps procédural par les acteurs de la mise en état, dans l'optique d'un procès équitable et efficace.
