Book excerpt: This memorandum responds to inquiries regarding whether the Deficit Reduction Act of 2005, S. 1932, 109th Cong., 1st Sess., was enacted as Public Law 109-171 in compliance with the Constitution. A question has been raised about whether the text of the enrolled version of S. 1932 that was sent to and signed by the President and certified as passing the Senate by the President pro tempore and the House by the Speaker accurateky reflected the text that each member had passed. A published report has indicated that after the Senate acted on the text the House has passed, an error allegedly was made in transcribing the Senate-passed text and that the incorrectly transcribed text, known as the engrossed version, was returned to the House which then agreed to it. It also has been reported that after the House passed the allegedly incorrectly transcribed engrossed text, the error was corrected by a Senate clerk before the bill was certified as passing the House by the Speaker and the Senate by the President pro tempore in the enrolled version before it was sent to President George W. Bush, who signed it on the afternoon of February 8, 2006.

However, the Senate amended the report, removing a few provisions as the result of a point of order raised associated with the "Byrd Rule." The amended agreement passed the Senate on December 21, 2005, and was returned to the House for further action. It is expected that the agreement will be taken up in the early part of the session. This report provides a comparison of Medicare, Medicaid and State Child Health Insurance Program provisions contained in the Deficit Reduction Act of 2005 (S. 1932) as amended and passed by the Senate. The report compares the bill's provisions with current law.

Book excerpt: The Deficit Reduction Act of 2005 (DRA, S. 1932) includes a scaled-back version of welfare reauthorization. Enactment of the DRA would end the four-year saga of welfare reauthorization legislation. The DRA would extend funding at current levels for basic state grants under the Temporary Assistance for Needy Families (TANF) block grant through Fiscal Year (FY) 2010, and has provisions that require states to either raise participation in work activities among families receiving cash welfare from TANF or further reduce the cash assistance rolls. The DRA also would extend Child Care and Development Fund (CCDF) mandatory funding through FY2010, increasing mandatory child care funding by $200 million per year from current levels (a total increase of $1 billion over five years). The DRA would further establish $100 million per year in TANF research and technical assistance funds for "healthy marriage promotion" initiatives and $50 million per year for "responsible fatherhood initiatives." This report will be updated.

Available in PDF, EPUB and Kindle. Book excerpt: Two major deposit insurance reform bills are currently before Congress. The Federal Deposit Insurance Reform Act of 2005, H.R. 1185, was initially approved by the House on May 4, 2005. The Safe and Fair Deposit Insurance Act of 2005, S. 1562, was reported as amended by the Committee on Banking, Housing, and Urban Affairs on October 18, 2005. Because both bills would effectively raise assessments paid by banks and savings associations to the deposit insurance funds, they contribute to the budget reconciliation process. The House bill reduces net direct spending by about $200 million over five years ($2.5 billion over 10 years), whereas the Senate bill scores reductions of $300 million over five years ($2.46 billion over 10 years). As a result, both bills have been attached to the budget reconciliation process. S. 1562 is Title II, Subtitles A and B of S. 1932, the Deficit Reduction Omnibus Reconciliation Act of 2005, passed by the Senate on November 3, 2005. In the House, H.R. 1185 is Title IV of H.R. 4241, the Deficit Reduction Act of 2005. Both deposit insurance bills, as passed (House) and as reported (Senate), are identical to their respective reconciliation versions. These measures, culminating years of congressional attention, share many provisions, yet differ significantly in others. Both would merge the Bank Insurance Fund (BIF) and the Savings Association Insurance Fund (SAIF) into a new Deposit Insurance Fund (DIF) for all depository institutions (except credit unions, which would continue with their own insurance fund). Both would replace the designated reserve ratio with a range within which the Federal Deposit Insurance Corporation (FDIC) would operate DIF. Both would raise the $100,000 coverage limit for deposit insurance for at least some accounts. Credit union coverage would change in step with banks and thrifts. Both bills would allow for refunds of excess reserves to wellcapitalized banks. Both bills would require the FDIC to give credit to institutions for past premium payments if the FDIC must make new assessments, thus accounting for the disparity between old and newer institutions. The bills differ in important respects. Insurance coverage limits rise immediately for most accounts in the House bill and would be indexed for inflation automatically at five-year intervals in the future. The Senate bill increases coverage limits immediately for retirement accounts and allows the FDIC, at its discretion, to increase limits for all accounts at five-year intervals in the future. The House allows for both one-time and ongoing credit pools against future premiums, whereas the Senate allows only an initial credit. The House, but not the Senate, would limit premiums paid by well-capitalized and operated banks, so long as the new insurance fund was within the reserve range. This report will be updated as warranted by events.

Book excerpt: Medicaid is jointly financed by the federal and state governments, but each state designs and administers its own state program under broad federal guidelines. Accordingly, state variation in eligibility, covered services, and the delivery of, and reimbursement for, services is the rule rather than the exception. President Bush's establishment of a Medicaid Commission in the spring of 2005, called on its members to advise the Secretary of the Department of Health and Human Services (DHHS) on ways to modernize the Medicaid program so that it can provide high-quality health care to its beneficiaries in financially sustainable ways. The Commission was created in part in response to reconciliation instructions from the budget committees of the House of Representatives and the Senate recommending reductions in Medicaid spending. The House and the Senate have since conferenced on an omnibus budget bill and each chamber has passed versions of S. 1932, the Deficit Reduction Act of 2005, although the Senate passed a version that must return to the House for a final vote. The bill, if passed by the House and signed by the President, would reduce program spending and, at the same time, introduce significant new flexibilities for the state run programs. During the past few years, the nation's Governors have asked Congress to provide them with relief from the increasing costs of Medicaid programs and, through the National Governors Association (NGA), have developed their own Medicaid reform plan. Other health and advocacy organizations propose expanding Medicaid to take on a greater role in providing access to medical care for the ever increasing number of individuals without health insurance. The different perspectives of Medicaid's major stakeholders generate seemingly opposing proposals to modify the program, and reflect what each group considers the program's major weaknesses. Those weaknesses, depending on the stakeholder's perspective, include overall high costs, the unpredictability of Medicaid's budget, its reliance on state funding, and its inability to do more for the uninsured. All of these perceived weaknesses are likely to become exacerbated by the long-term demographic outlook of the U.S. population. As more baby boomers retire and more long-term care services are needed by an ever-growing population of elderly individuals, Medicaid's role and cost are likely to become even more scrutinized. How is Congress to respond to the numerous proposals to move Medicaid forward into the near and long term? This document lays out some of these issues, explains the factors underlying them, and provides links to CRS products that can help Members of Congress and their staff prepare to discuss Medicaid's role today and into the future. This report will be updated as legislative action occurs.
