Available in PDF, EPUB and Kindle. Book excerpt: Intestate Succession is the second volume in the Comparative Succession Law series which examines the principles of succession law from a comparative and historical perspective. This volume discusses the rules which apply where a person dies either without leaving a valid will, or leaving a will which fails to dispose of all of the person's assets. Among the questions considered are the following: What is the nature of the rules for the disposal of the deceased's assets? Are they mechanical or is there an element of discretion? Are particular types of property dealt with in particular ways? Is there entitlement to individual assets (as opposed to money)? Do the rules operate in a parentelic system or a system of some other kind? Are spouses treated more favourably than children? What provision is made for extra-marital children, for adopted children, for step-children? Does cohabitation give rise to entitlement? How are same-sex couples treated? Broader questions also arise of a historical and comparative nature. Where, for example, do the rules in intestate succession come from in particular legal systems? Have they been influenced by the rules in other countries? How are the rules explained and how are they justified? To what extent have they changed over time? What are the long-term trends? And finally, are the rules satisfactory, and is there pressure for their reform? As in the first volume, this book will focus on Europe and on countries which have been influenced by the European experience such as Australia, New Zealand, South Africa, the United States of America, Quebec, and the countries of Latin America. Further chapters are devoted to Islamic Law and Nordic law. Opening with a discussion on Roman law and concluding with an assessment of the overall development of the law in the countries surveyed, this book will provide a wider reflection on the nature and purpose of the law of intestate succession.

Available in PDF, EPUB and Kindle. Book excerpt: "Andrew R. Dyck's full commentary on this work is the first to appear in English or any other language for over a century. Whereas previous commentaries focused primarily on grammar and textual criticism, this one, while not neglecting those areas, insightfully relates the text to the trends, political, philosophical, and religious, of Cicero's times; identifies the influences on Cicero's thinking; and analyzes the relation of this theoretical treatise to his other utterances, public and private, of the time."--BOOK JACKET.

Available in PDF, EPUB and Kindle. Book excerpt: This Dictionary: explains technical Roman legal terms, translates & elucidate those Latin words which have a specific connotation when used in a juristic context or in connection with a legal institution or question, & provides a brief picture of Roman legal institutions & sources as a sort of an introduction to them. The objectives of the work, not the juristic character of available Latin writings, therefore, determined the inclusion or exclusion of any single word or phrase. This dict. is not intended to be a complete Latin-English dict. for all words which occur in the writings of the Roman jurists or in the various codifications of Roman law. The reader must consult a general Latin-English lexicon for ordinary words that have no specific meaning in law or juristic language. Reprinted 1980.

Available in PDF, EPUB and Kindle. Book excerpt: The question of Historic Titles in International Law has been much discussed in recent years. In particular, it was an issue of some im portance in several international arbitrations, such as the Gulf of Fon seca case, decided by the Central American Court of Justice; the Island of Palmas case, decided by Judge Huber as sole arbitrator, under the auspices of the Permanent Court of Arbitration; the case concerning the Legal Status rif Eastern Greenland before the Permanent Court of International Justice; and, more recently still, the cases concerning Fisheries (United Kingdom v. Norway); Minquiers and Ecrehos Islets (U nited Kingdom v. France) ; Certain Frontier Land (Belgium v. N ether lands); and Temple rif Preah Vihear (Cambodia v. Thailand), before the International Court of Justice. Historic Titles are probably also a re levant factor in a number of territorial disputes that have not yet been submitted to arbitration or judicial settlement. The recent controversies over the proper breadth for the territorial sea and the exclusive fishing limits of coastal States have brought to the fore new aspects of the problem.
