To tell the truth, and at the same time to avoid a lapse into the horrors of grandiloquence, would have been one of the supreme tests of literary skill. But Nature has an unbroken custom of inserting the compensation balance into her work; and thus, in the case of Webster, it came about that he was unkindly kept alive a little too long, whereby he encountered the occasion of the seventh of March, 1850, and made upon that day a speech which is perhaps the most famous in our history, and also surely the most unfortunate. The order of subse quent events shows plainly that there was no rea son for this too long survival upon his part. For his great work had already been done; and neither that speech, nor anything which he did afterward in the brief remainder of his life, much afiected the course of events in the country. We are a smitten nation. The symbols of mourning meet the eye in our crowded cities, in our tranquil Villages, in the remotest hamlets of the mountains. A great man has fallen in Israel! God has taken from us the honourable man, and the counsellor, and the eloquent orator. If such a man is one of the choicest earthly gifts heaven can bestow upon a people, his removal may well be regarded as one Of their greatest bereavements. We are admo nished that the fall of a sparrow has its lesson Of in struction for us. How inexcusable would it be, should we treat an event like this with indifference. Yet while I recognise the duty upon which I am entering, I shrink from it. I have no hope Of convey ing to your minds my own sense Of the magnitude Of our loss. Still less can I expect to elude the strictures of those who entertain What may, perhaps, be styled the popular View of the legitimate sphere of the pulpit. But I am pressed with the feeling that I must, as a Pastor, in some way improve this dispensation thatwithout attempting a formal eulogy on Mr. Webster, which would be in the highest degree presumptuous, I must here record my sense of the invaluable services he has rendered to our common country and our common Christianity, and so endeavour to turn the emotions of sorrow which fill our hearts, to some use ful account. It is fortunately not an inferred or constructive power, but one of the express grants of the Constitution. Congress shall have power to establish uni form laws on the subject of bankruptcies throughout the United States. These are the words of the grant; there may be ques tions about the extent of the power, but there can be none of its existence. The bill which has been reported by the committee provides for voluntary bankruptcies only. It contains no provisions by which creditors, on an alleged act of bankruptcy, may proceed against their debtors, with a View to subject them and their prop erty to the Operation of the law. It looks to no coercion by a creditor to make his debtor a subject of the law against his will. This is the first characteristic of the bill, and in this respect it certainly differs from the former bankrupt laws of the United States, and from the English bankrupt laws. The bill, too, extends its provisions, not only to those who, either in fact or in contemplation of law, are traders, but to all persons who declare themselves insolvent, or unable to pay their debts and meet their engagements, and who desire to assign their property for the benefit of their creditors.
