Available in PDF, EPUB and Kindle. Book excerpt: This book consists of six related but separate parts combined in thirteen continuous chapters of land law. The thirteen chapters are fundamentally concerned with the development of the customary land law through the Ghanaian courts. In the first part, the main concepts underlying land law as well as the general characteristics of land are traced and analysed. The second segment deals with the law relating to interests in land, including modes of acquisition and loss of title. Tenancies and pledges are examined in their own right. Part 3 considers the nature of the customary law family, focusing on the composition of the family, the rights of members and the role of the head of family. In Part 4, rules regarding transfer of interests are considered within the general body of case law. This is followed logically by a consideration of the applicable doctrines of English law in Part 5. The final segment directs analysis at the impact of state legislative activity on customary law.The rules of customary law were developed from pre-colonial times. It might be thought that the rules might be full of hoary anachronisms. The continuous decisions of the courts and the full impact of legislative activity have been the guiding hand in steering the customary land law in consonance with social and economic developments. No one argues that the customary law is in need of purgation. Principles derived from English equity jurisprudence have steadily worked their way into customary notions, particularly in the form of acquiescence, introducing equity's peculiar element of fairness into the relevant customary law rules. Some of the perceived harshness or inadequacy of the customary land law have also been cured by legislation. The present work is not a mere rearrangement of emphasis of the land law. I have attempted to bring into one coherent view the ideas expressed by the established jurists. The law we work with is constantly changing. It is constantly between the hammer and the anvil, changed and reshaped by judicial and statutory intervention. New answers are found as problems without judicial precedent press for statutory solution. Where authoritative answers cannot be found for such problems, I have relied on the evidence of actual social practice. Overall this book captures the restlessness of the indigenous law and the constant push for change. Several of the topics that dominated the old texts are receding. Statute law now overshadows many areas of the customary law. There is considerable imbalance in the rendering of the customary land law of Ghana. Although this is a book on the customary land law of Ghana, a disproportionate number of both actual examples and case-law are drawn from southern Ghana. It reflects the general lacuna in current literature. This deficiency points to the urgent necessity of prosecuting a similar task in relation to the customary law of northern Ghana.

Book excerpt: I have had the privilege to peruse through this book by the learned author, Justice Osei Tutu. And I have one adjective to describe the book: 'IMPRESSIVE'! The learned author and Justice of the High Court adds to the growing list of Justices of Ghana's Superior Courts who have authored law books which have indubitably contributed to enrich legal research and practice in this country. Particularly for practicing lawyers at the Bar, it is refreshing to have our judges author books, to not only add to the existing legal literature but to appreciate the mindset of our judges and perspective from the Bench, in whose bosom the law lies. Judges, as public officials, I surmise, have a great deal to contribute to demystifying principles of law and its practice at our courts; and this is what the author has accomplished by this book. The learned author, since his elevation to the High Court in 2013 has had a reputation for being a stickler for details and affirnity for scholarly writings and judgments - a skill such that he effortlessly brings to bear in this book. I thus strongly recommend this book to lawyers, law students and lecturers, who would without a smidgen of doubt, greatly find it instructive in their legal endeavours. Yaw Boafo Esq. National President, Ghana Bar Association Justice Alexander Osei Tutu demonstrates a finesse in legal thinking that few can match. This book comes to complement his bourgeoning legal scholarship and serves to enrich the literature in the diverse substantive and procedural fields of law the two volumes cover. Lawyers, Judges, scholars and students will truly find the book a handy source material in their endeavours. Professor Ernest Kofi Abotsi Dean, Faculty of Law, UPSA This book is not just another addition to myriads of works on Ghanaian land law but more importantly a critical perspective on aspects of our law that have been significantly affected by provisions of the new Land Act 2020 and the groundbreaking modifications being made by our Supreme Court to land law and customary law at a rather fast pace than before. The author does not merely synthesize these new developments but seeks to deploy probing scholarship in exploring these contemporary trends in Ghanaian law. The audacity of the author to pinpoint manifest problematic dimensions of the provisions of the new Land Act in relation to well known doctrines like allodial title, eminent domain, and spousal property rights provides unique enthusiasm that propels the reader to seek to engage other topics in different chapters of the book so as to arrive at the destination the author is gravitating towards with his thought provoking and critical expositions. Undoubtedly, the book deals with themes that are carefully selected in terms of currency, relevancy and utility to lawyers, judges, law makers, law students and members of the public. This great work must certainly be read by everyone who is determined to appreciate recalibration of many areas of Ghanaian law in contemporary times. Dr. Ernest Owusu-Dapaa Dean, Faculty of Law Kwame Nkrumah University of Science and Technology, Kumasi.

Available in PDF, EPUB and Kindle. Book excerpt: The present work brings to completion my effort to state the complete law of property of Ghana. It was inspired by my earlier work on the customary land law of Ghana. The customary law remains the heart of the Ghanaian land law, but the story of the property law of Ghana is incomplete without a comprehensive account of the received law of property. The present work, therefore, brings to a full circle my efforts to state accurately and wholly the property law of Ghana. The field of Ghanaian property law is dominated by a combination of foreign and indigenous concepts. Arguably, the theoretical aspects of the property law of Ghana stand in need of resolution of the tensions between the two sources of law. The development of the English law of property was deeply marked by the early activities of the King's Court and its administration of a centralised system of law as distinguished from an earlier system of localised customary law, varying from place to place. Modified by equity, its doctrines were developed from a centralised system of records. A course in property law ought to equip the student with the entire range of concepts in the field, closely analysed. Described elsewhere as a rubbish heap that has been accumulating for centuries and understood only by the professors, the English law of property does not lend itself to easy understanding. Imposing structure upon a subject comprising essentially English law of property and applying it to Ghanaian circumstances has not been easy. To help the student grasp the interlocking nature of the concepts, and to gain rounded and more profound insights about the various rights and liabilities attached to interests in land, a persistent effort is made to connect the material to Ghanaian cases and statutes. Intended to complement the larger works on the law of real property, much of this book derives from the experience of teaching property law to students at the Faculty of Law, University of Ghana. For over ten years now, I have been involved in the teaching of courses in land law to various groups of students, coming as they do from a background where an encounter with law teaching is invariably new. Many have contributed novel ideas and insights, and the great majority require a sound grounding in a very important aspect of our law. The focus is to equip them with a solid academic basis both for a subsequent course in conveyancing and for effective legal practice. The older books on the property law of Ghana belong to the last century, written, as the majority are, in the 1960s and 1970s. In organisation and scope this book is in two parts: historical development of English ideas of property and the law of landlord and tenant embracing leases and the Rent Act, 1963. I have clearly left out of the present work the subjects of registration of land and State intervention in land ownership as well as a number of statutory matters as they were adequately covered in my previous works.

Book excerpt: " The European colonial powers imposed their land laws on many countries in Africa, Asia and Latin America. These were often at variance with indigenous customs regulating land use. After attaining independence the new states mostly adhered to the colonial laws and did not revert to earlier customary law. The present volume contains contributions to a conference supported by the European Science Foundation and held at the Internationales Wissenschaftsforum Heidelberg in November 1991. The countries discussed by the authors include several West African states, India and Indonesia in Asia and Mexico and Surinam in Latin America. The volume should be of interest to anthropologists and historians as well as to law scholars. Jap de Moor arbeitet am Centre for the History of European Expansion, Universität Leiden, Niederlande. "
