Available in PDF, EPUB and Kindle. Book excerpt: Tourism in European Microstates and Dependencies carefully examines the nuances and realities associated with tourism, social and economic development, geography, and geopolitics of Europe's smallest microstates and dependencies. Through case study-based material, the book covers the smallest states of Europe, the European dependencies inside Europe, and other unique territorial anomalies and unrecognized de facto states. It looks at how, besides small size and economy of scale, one of the characteristics that connects these unique states and territories is their dependence on tourism, or their desire to develop it, for their socio-economic well-being.

Available in PDF, EPUB and Kindle. Book excerpt: The Financial Services (Banking Reform) Bill aims to establish a more resilient, stable and competitive banking sector; to reduce the severity of a future financial crisis; and to protect taxpayers in the event of such a crisis. It is primarily an enabling Bill, which provides HM Treasury with the requisite powers to implement the policy underlying the Bill through secondary legislation. Three illustrative draft instruments were published in March 2013 in order to aid Parliamentary scrutiny of the Bill, and the Government has continued to develop those instruments. This paper invites comments on a further four statutory instruments: Ring-fenced Bodies and Core Activities Order; Excluded Activities and Prohibitions Order; Banking reform (Loss Absorbency Requirement) Order; and the Fees and Prescribed International Organisations Regulations. Further secondary legislation is planned for pensions and building societies.

Download or read book Crown Dependencies written by Great Britain: Parliament: House of Commons: Justice Committee and published by The Stationery Office. This book was released on 2008 with total page 24 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Isle of Man, Jersey and Guernsey are self-governing dependencies of the UK. These "Crown Dependencies" have their own directly-elected legislatures together with independent legal, administrative and fiscal systems. UK legislation only extends to them with the consent of the relevant legislatures. The UK Government represents the Crown Dependencies in international and defence matters, a role for which it receives annual payment from each dependency. The Ministry of Justice is the UK Government department responsible for managing the UK's constitutional relationship with the Crown Dependencies and the department's performance in doing so falls within the remit of this Committee. In 2008 problems in the Icelandic banking sector (also affecting subsidiaries of Icelandic banks in, inter alia, the UK, Isle of Man and Guernsey) and the UK authorities' response gave rise to a number of issues which, in the opinion of the Committee, merited examination. Many UK-based depositors in banks in the Crown Dependencies fear that they may have lost most or all of their savings and want to know what responsibilities the UK Government has in these matters. The Committee took evidence from Lord Bach, Parliamentary Under-Secretary of State, Ministry of Justice and received written evidence. Prior to this, in November 2008, the Committee had the benefit of an informal meeting with a delegation from Tynwald, the Isle of Man legislature, led by its President, Hon Noel Cringle MLC. The Committee believes that some questions over the relationship between the UK and the Crown Dependencies remain to be answered and that further clarity on the way in which the dependencies' interests are protected by the UK Government is required. The situation is further complicated by the relationships between the parent banks in Iceland and their subsidiaries in the UK, the Isle of Man and Guernsey as well as between the financial regulators in each jurisdiction. The Committee was not sure that the arrangements within the Government were adequate to deal with all aspects of the recent crisis. The Committee intend to return to the wider issues, and the performance of the Ministry of Justice in these matters, in the New Year. There is also the independent review of the immediate and long-term challenges facing British offshore financial centres in the current economic climate commissioned by HM Treasury.

Book excerpt: The book reviews the EU Treaties provisions governing relations between the EU and Member State territories, such as the Netherlands Antilles, the UK Channel Islands and the French Overseas Departments. The book includes an overview of each of the relevant territories, including their present constitutional relations with their Member State and their legal relations with the EU. Prior to the entry into force of the Lisbon Treaty, the over-arching Treaty provision for this relationship was Article 299 of the EC Treaty. Having traced the development of Article 299 from 1957 to the present Lisbon framework, the book identifies many inconsistencies and issues with this current framework and proposes a new model framework, one that is more concise and up-to-date and which is adaptable to possible future developments. Useful for EU Law departments and Research Centres, EU Think Tanks, EU Institutions Libraries, Permanent Representatives to the EU and law firms specializing in EU law.

Available in PDF, EPUB and Kindle. Book excerpt: This book is about two things: tax and power. The processes through which tax law is formulated, involve more than the formal legislative and judicial processes which result in statute and case law. Tax law is an expression of tax policy, which is subjective and a heterogeneous product of states, cultures and politics. Regarding taxation as a branch of either black letter law or orthodox economics ignore, or even deny, this subjectivity. This book explores the complex dynamics of the debates which inform tax policy, the interaction between tax and power and how power relations between various groups in society and between individuals and the state are manifested through tax system. This helps to explain why the rules, procedures and practices are all formulated to suit their interests of the most powerful groups in society. Taxation is a powerful lens through which to analyse relationships between individuals and the state, since history has shown that there is a longstanding power relationship between rulers and subjects, which is articulated through tax regimes. Tax can therefore be seen as a technology which mediates such tensions and relationships and the way that choices are made and conflicts are resolved can give valuable insights into societal power relationships.
