This incorporates the suggestion of Senator Abourezk, contained in a separate Senate bill. There is no question that kidnapping is one Of the most serious crimes against the person. Under 18 u.s.o. 1201, when committed within the Special maritime and territorial jurisdiction, kidnapping is punishable by up to life imprisonment. Therefore, by Operation of 18 u.s.o. 1152, a non-indian who kidnaps an Indian on an Indian reservation, or an Indian who kidnaps a non Indian therein, is subject to federal prosecution and punishment under the terms of 18 u.s.o. 1201. An Indian who kidnaps another Indian on a reservation, however (and who does not transport his victim across any State or national boundaries), would not be federally punishable and would be subject to proseou tion, if at all, only by a tribal court which can impose no more than six months' imprisonment. 25 u.s.o. This disparity, which discriminates against Indian victims, will be eliminated by the inclusion of kidnapping as a crime under 18 u.s.o. 1153. This report unravels some of the reasons why Indigenous women in the USA are at such risk of sexual violence and why survivors are so frequently denied justice. Chronic under-resourcing of law enforcement and health services, confusion over jurisdiction, erosion of tribal authority, discrimination in law and practice, and indifference -- all these factors play a part. None of this is inevitable or irreversible. The voices of Indigenous women throughout this report send a message of courage and hope that change can and will happen.

Book excerpt: Public Law 280 transferred jurisdiction over criminal and civil matters from the federal to state governments and increased the extent of nontribal law enforcement in selected parts of Indian country. Where enacted, the law fundamentally altered the preexisting legal order. Public Law 280 thus provides a unique opportunity to study the impact of legal institutions and their change on socioeconomic outcomes. The law's controversial content has attracted interest from legal scholars. However, empirical studies of its impact are scarce and do not address the law's endogenous nature. We examine the law's impact on crime and on economic development in U.S. counties with significant American-Indian reservation population. To address the issue of selection of areas subject to Public Law 280, our empirical strategy draws on the law's politico-historical context. We find that the application of Public Law 280 increased crime and lowered incomes. The law's adverse impact is robust and noteworthy in magnitude.
