Book excerpt: GAO reported on the Environmental Protection Agency's (EPA) major efforts to prepare cost-benefit analyses to support regulatory decisions, as required under Executive Order 12291. In addition, it discussed the Office of Management and Budget's (OMB) review of those analyses and identified many problems that affect the potential usefulness of cost-benefit analyses for assessing environmental regulations. GAO found large gaps in the underlying scientific information which EPA uses to estimate the environmental benefits of its regulatory alternatives. EPA has also had difficulty determining how much people are willing to pay for health and environmental improvements. However, a cost-benefit analysis can still provide useful information to regulatory decisionmakers if EPA presents a range of dollar values which reflect the uncertainty of the estimates. Some environmental laws place more emphasis on the level of cleanup to be achieved than on the costs involved, and they may prohibit or limit the use of cost-benefit analyses in setting standards and regulations. In addition, cost-benefit analyses are not transmitted to Congress. Executive Order 12291 generally requires EPA and other federal agencies to provide a detailed cost-benefit analysis for any major regulation. However, the Order allows for a great deal of flexibility in establishing the estimated costs of proposed regulations, and EPA has not always considered all important compliance costs to determine whether a proposed rule is a major regulation. In addition, GAO found that EPA failed to consider all possibilities in determining which alternative would yield a higher net benefit. GAO also found that EPA cost-benefit analyses generally highlighted only single-dollar estimates in summary form, while ranges of estimates for other categories were available but not used. Despite these problems, OMB has generally accepted the EPA analyses.

Lawmakers in the advanced economies have used cost-benefit analysis to evaluate core environmental and public health questions, such as urban air pollution control, water quality, and occupational safety. Yet despite its broad adoption in the industrialized world, most developing and emerging countries have not yet incorporated cost-benefit analysis into their policymaking process. Because these countries face significant limitations on financial resources and have less ability to shoulder inefficient rules, it is extremely important for their officials to determine which policies maximize net benefits for their societies. The Globalization of Cost-Benefit Analysis in Environmental Policy examines how cost-benefit analysis can help developing and emerging countries confront the next generation of environmental and public-health challenges. Analysis in the book examines the growing reach of cost-benefit analysis; presents relevant case studies where cost-benefit analysis has been incorporated in the Americas, Africa, Middle East, and Asia; and includes a discussion on the conceptual and institutional issues that must be addressed when adopting cost-benefit analysis in developing and emerging countries. The entrenchment of a camp of detractors and a camp of advocates of cost-benefit analysis parallels the impasse that has stymied environmental law for over a decade. Professors Lisa Heinzerling and Frank Ackerman have co-authored the book Priceless, that captures most of the arguments from the detractor side, and have done so skillfully. However, this review essay criticizes the book's contribution to perpetuating this intellectual stalemate. The book does this by narrowly focusing on an environmental theory of moral absolutism, and by attempting to exclude economic considerations altogether from the environmental law and policy-making process. Heinzerling and Ackerman's attack on cost-benefit analysis and general economic analysis over-reaches, and attempts to prove far more than is possible, even given the somewhat unfavorable record of economics in environmental and safety policy. What is needed is some way of separating out environmental problems that are largely economic in nature, that can be informed by cost-benefit analysis, from those problems that are largely moral in nature and cannot be informed by cost-benefit analysis. While Heinzerling and Ackerman would deny the pertinence of such a question, this review essay proposes some ideas on how to draw this line. One set of environmental and risk problems that should be removed from the realm of economics are problems in which the risk of harm is relatively high, such that the risk becomes outright danger. When that occurs, the risk begins to resemble an intentional harm, and should be regulated without regard to a weighing of costs and benefits. Another set of environmental and risk problems that should be insulated from cost-benefit analysis concerns situations in which a discrete group is singled out for physical harm on some basis that we find objectionable, such as race. When environmental justice concerns are implicated, there is no effective way of monetizing the harm of being chosen to bear physical harm. By attempting to draw this line, this review essay attempts to break the stalemate and to advance the debate over the proper role for cost-benefit analysis in environmental and safety regulation.
