Book excerpt: Slaves were property of their dominus, objects rather than persons, without rights: These are some components of our basic knowledge about Roman slavery. But Roman slavery was more diverse than we might assume from the standard wording about servile legal status. Numerous inscriptions as well as literary and legal sources reveal clear differences in the social structure of Roman slavery. There were numerous groups and professions who shared the status of being unfree while inhabiting very different worlds. The papers in this volume pose the question of whether and how legal texts reflected such social differences within the Roman servile community. Did the legal system reinscribe social differences, and if so, in what shape? Were exceptions created only in individual cases, or did the legal system generate privileges for particular groups of slaves? Did it reinforce and even promote social differentiation? All papers probe neuralgic points that are apt to challenge the homogeneous image of Roman slave law. They show that this law was a good deal more colourful than historical research has so far assumed. The authors’ primary concern is to make this legal diversity accessible to historical scholarship.

Book excerpt: All discourses aimed at asserting the value of human life as such—whether philosophical, ethical, or political—assume the notion of personhood as their indispensable point of departure. This is all the more true today. In bioethics, for example, Catholic and secular thinkers may disagree on what constitutes a person and its genesis, but they certainly agree on its decisive importance: human life is considered to be untouchable only when based on personhood. In the legal sphere as well the enjoyment of subjective rights continues to be increasingly linked to the qualification of personhood, which appears to be the only one capable of bridging the gap between human being and citizen, right and life, and soul and body opened up at the very origins of Western civilization. The radical and alarming thesis put forward in this book is that the notion of person is unable to bridge this gap because it is precisely what creates this breach. Its primary effect is to create a separation in both the human race and the individual between a rational, voluntary part endowed with particular value and another, purely biological part that is thrust by the first into the inferior dimension of the animal or the thing. In opposition to the performative power of the person, whose dual origins can be traced back to ancient Rome and Christianity, Esposito pursues his strikingly original and innovative philosophical inquiry by inviting reflection on the category of the impersonal: the third person, in removing itself from the exclusionary mechanism of the person, points toward the orginary unity of the living being.

In Tabula Picta Marta Madero turns to the extensive glosses and commentaries that medieval jurists dedicated to the above questions when articulating a notion of intellectual and artistic property radically different from our own. The most important goal for these legal thinkers, Madero argues, was to situate things—whatever they might be—within a logical framework that would allow for their description, categorization, and placement within a proper hierarchical order. Book excerpt: This book explores the reactions to Europeanization and globalization in times of economic distress, including the transformation of European values in national legal cultures. The authors explore how European values, tradition and new legal challenges interconnect and dictate the paths of transition between old and new Europe. The first chapter starts with a question: can Roman Legal Tradition play a role of identity factor towards a New Europe? Can it be considered as a general value identifying new Europe, built on a minimum core of principles – persona, dominum, obligation, contract and inheritance – composing the whole European private law tradition? Subsequent chapters attempt to provide possible responses to the question: what is Europe today? The answers diverge, depending on the research area. The inherent dichotomy of human rights protection in Europe and the concept of ‘one law, one court’ are investigated in the second chapter, whereas the third chapter focuses on asylum and the interrelation and interdependence of the Court of Justice of the EU and the European Court of Human Rights. The next three chapters concentrate on matters of equal treatment and non-discrimination. The first contribution in this part reflects on the crisis and methodological and conceptual issues faced by modern anti-discrimination law. It is followed by a specific analysis of the empowerment of women or gender-balancing in company boards. The third contribution reveals the impact of the Croatian anti-discrimination law on private law relations. The next chapter deals with the issue of social rights in Croatia and the method of their regulation in the context of the new European values. The immense challenges posed by the market integration imperative and democratic transition have brought about different reactions in the national legal systems and legal cultures of both old and new Member States. As such, Europe has effectively been reunited, but what about the convergence of national legal cultures? This is the focal point of the remaining chapters, which focus on various issues, from internal market, competition law, consumer welfare, liberalization of network industries to the EU capital market. The magnitude of EU activity in these areas offers conclusive evidence that old and new paradigms are evolving and shaping the future of the EU.
