Book Synopsis La corruzione nelle leggi by : Vittorio Italia
Download or read book La corruzione nelle leggi written by Vittorio Italia and published by Key Editore. This book was released on 2018-05-30 with total page 146 pages. Available in PDF, EPUB and Kindle.
Book Synopsis Corruzione pubblica by : Francesco Carlo Palazzo
Download or read book Corruzione pubblica written by Francesco Carlo Palazzo and published by Firenze University Press. This book was released on 2011 with total page 111 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book contains the proceedings of the seminar held in Florence on 6 May 2011 within the framework of a research project of national scope funded by the Ministry of Education (MUIR). The principal inspiring aim is the quest for synergy between criminal law and administrative law in the activities aimed at fighting corruption. The 'final' interests damaged by corruption are fundamental (public safety, national economy), such as to demand the stigmatisation and efficacy inherent to the penal instrument. However, no less important is the prevention aspect recommended by the European and international institutions, which can be achieved through a real and effective reinforcement of administrative instruments, such as the prevention of conflicts of interest or the strengthening of the disciplinary system.

Available in PDF, EPUB and Kindle.

Book Synopsis Five Albanian Villages by : Antonio Laurìa
Download or read book Five Albanian Villages written by Antonio Laurìa and published by Firenze University Press. This book was released on 2020-12-27 with total page 322 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the result of a research project designed and carried out at the Department of Architecture, University of Florence. This research was based on the transfer of knowledge from members of the Albanian Diaspora in Italy (university students, young architects and researchers) to their home country. This unique process blazed a trail in the Albania-related studies by creating a methodology, which could be replicated not only in Albanian rural contexts, but also elsewhere. The book constitutes a structured tool for generating sustainable and socially inclusive territorial development processes in five lesser-known Albanian cultural sites. Their tangible and intangible cultural heritage was seen as a driving factor for triggering development processes aimed at improving the inhabitants’ quality of life and strengthening local identity and social networks. Through concrete proposals and strategies, the book offers scenarios and solutions capable of enhancing the potential of each village and, at the same time, counteracting the effects of land abandonment that so often characterise them.

Book Synopsis National Constitutions in European and Global Governance: Democracy, Rights, the Rule of Law by : Anneli Albi
Download or read book National Constitutions in European and Global Governance: Democracy, Rights, the Rule of Law written by Anneli Albi and published by Springer. This book was released on 2019-05-29 with total page 1522 pages. Available in PDF, EPUB and Kindle. Book excerpt: This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. The extradition cases are also of interest to scholars and practitioners in the field of criminal law. Anneli Albi is Professor of European Law at the University of Kent, United Kingdom. Samo Bardutzky is Assistant Professor of Constitutional Law at the University of Ljubljana, Slovenia.
Book Synopsis Nullum Crimen Sine Lege, the European Convention on Human Rights and the Foreseeability of the Law by : Sara Paiusco
Download or read book Nullum Crimen Sine Lege, the European Convention on Human Rights and the Foreseeability of the Law written by Sara Paiusco and published by . This book was released on 2021-06-30 with total page 491 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book investigates nullum crimen sine lege as European principle in its interpretation by the European Court of Human Rights. The research focuses on the role of foreseeability as a solution to the legality issues raising from judge-made law in criminal law. The rationale and application of foreseeability in ECtHR case-law are scrutinised, trying to extract its main development paths. Current solutions adopted by civil law States (Italy and Germany) are analysed also considering the theoretical foundations of ncsl. Moreover, the role of foreseeability in EU law is considered, as an example of an effectiveness-oriented legal order. In the end, future perspectives for the implementation of the principle of foreseeability are analysed.

This book was released on 2020-06-08 with total page 434 pages. Available in PDF, EPUB and Kindle. Book excerpt: The refreshed insights into early-imperial Roman historiography this book offers are linked to a recent discovery. In the spring of 2014, the binders of the archive of Robert Marichal were dusted off by the ERC funded project PLATINUM (ERC-StG 2014 n°636983) in response to Tiziano Dorandi’s recollections of a series of unpublished notes on Latin texts on papyrus. Among these was an in-progress edition of the Latin rolls from Herculaneum, together with Marichal’s intuition that one of them had to be ascribed to a certain ‘Annaeus Seneca’. PLATINUM followed the unpublished intuition by Robert Marichal as one path of investigation in its own research and work. Working on the Latin P.Herc. 1067 led to confirm Marichal’s intuitions and to go beyond it: P.Herc. 1067 is the only extant direct witness to Seneca the Elder’s Historiae. Bringing a new and important chapter of Latin literature arise out of a charred papyrus is significant. The present volume is made up of two complementary sections, each of which contains seven contributions. They are in close dialogue with each other, as looking at the same literary matter from several points of view yields undeniable advantages and represents an innovative and fruitful step in Latin literary criticism. These two sections express the two different but interlinked axes along which the contributions were developed. On one side, the focus is on the starting point of the debate, namely the discovery of the papyrus roll transmitting the Historiae of Seneca the Elder and how such a discovery can be integrated with prior knowledge about this historiographical work. On the other side, there is a broader view on early-imperial Roman historiography, to which the new perspectives opened by the rediscovery of Seneca the Elder’s Historiae greatly contribute.

Book Synopsis Crime in the Art and Antiquities World by : Stefano Manacorda
Download or read book Crime in the Art and Antiquities World written by Stefano Manacorda and published by Springer Science & Business Media. This book was released on 2011-02-26 with total page 446 pages. Available in PDF, EPUB and Kindle. Book excerpt: The theft, trafficking, and falsification of cultural property and cultural heritage objects are crimes of a particularly complex nature, which often have international ramifications and significant economic consequences. Organized criminal groups of various types and origins are involved in these illegal acts. The book Crime in the Art and Antiquities World has contributions both from researchers specializing in the illegal trafficking of art, and representatives of international institutions involved with prevention and detection of cultural property-related crimes, such as Interpol and UNESCO. This work is a unique and useful reference for scholars and private and public bodies alike. This innovative volume also includes an Appendix of the existing legal texts, i.e. international treaties, conventions, and resolutions, which have not previously been available in a single volume. As anyone who has undertaken research or study relating to the protection of cultural heritage discovers one of the frustrations encountered is the absence of ready access to the multi- various international instruments which exist in the field. Since the end of the Second World War these instruments have proliferated, first in response to increasing recognition of the need for concerted multinational action to give better protection to cultural property during armed conflict as well as ensuring the repatriation of cultural property looted during such conflict. Thus the international community agreed in 1954 upon a Convention for the Protection of Cultural Property in the Event of Armed Conflict. That Convention, typically referred to as the Hague Convention of 1954, is now to be found reproduced in the Appendix to this book (Appendix I) together with 25 other important and diverse documents that we believe represent a core of the essential international sources of reference in this subject area. In presenting these documents in one place we hope that readers will now experience less frustration while having the benefit of supplementing their understanding and interpretation of the various instruments by referring to individual chapters in the book dealing with a particular issue or topic. For example, Chapter 9 by Mathew Bogdanos provides some specific and at times rather depressing descriptions of the application in the field of the Hague Convention 1954, and its Protocols (Appendices II and III), to the armed conflict in Iraq. Reference may also be had to the resolution of the UN Security Council in May 2003 (Appendix VI) urging Member States to take appropriate steps to facilitate the safe return of looted Iraqi cultural property taken from the Iraq National Museum, the National Library and other locations in Iraq. Despite such pleas the international antiquities market seems to have continued to trade such looted property in a largely unfettered manner, as demonstrated by Neil Brodie in Chapter 7. Fittingly, as referred to in the Preface to this book, the last document contained in the Appendix (Appendix 26) is the “Charter of Courmayeur”, formulated at a ground breaking international workshop on the protection of cultural property conducted by the International Scientific and Professional Advisory Council (ISPAC) to the United Nations Crime Prevention and Criminal Justice Program in Courmayeur, Italy, in June 1992. The Charter makes mention of many of the instruments contained in the Appendix while also foreshadowing many of the developments which have taken place in the ensuing two decades designed to combat illicit trafficking in cultural property through international collaboration and action in the arena of crime prevention and criminal justice.
Book Synopsis Aspects of Violence by : W. Schinkel
Download or read book Aspects of Violence written by W. Schinkel and published by Springer. This book was released on 2010-02-03 with total page 259 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a novel approach to the social scientific study of violence. It argues for an 'extended' definition of violence in order to avoid subscribing to commonsensical or state propagated definitions of violence, and pays specific attention to 'autotelic violence' (violence for the sake of itself), as well as to terrorism.
