As lawmakers work to protect LGBT citizens and women seeking reproductive freedom, religious traditionalists assert their right to dissent from what they see as a new liberal orthodoxy. Some religious advocates are going further and expressing skepticism that egalitarianism can be defended with reasons at all. Legal experts have not offered a satisfying response—until now. Nelson Tebbe argues that these disputes, which are admittedly complex, nevertheless can be resolved without irrationality or arbitrariness. In Religious Freedom in an Egalitarian Age, he advances a method called social coherence, based on the way that people reason through moral problems in everyday life. Social coherence provides a way to reach justified conclusions in constitutional law, even in situations that pit multiple values against each other. Tebbe contends that reasons must play a role in the resolution of these conflicts, alongside interests and ideologies. Otherwise, the health of democratic constitutionalism could suffer. Applying this method to a range of real-world cases, Tebbe offers a set of powerful principles for mediating between religion and equality law, and he shows how they can lead to workable solutions in areas ranging from employment discrimination and public accommodations to government officials and public funding. While social coherence does not guarantee outcomes that will please the liberal Left, it does point the way toward reasoned, nonarbitrary solutions to the current impasse.

Book excerpt: The Picky Eagle explains why the United States stopped annexing territory by focusing on annexation's domestic consequences, both political and normative. It describes how the US rejection of further annexations, despite its rising power, set the stage for twentieth-century efforts to outlaw conquest. In contrast to conventional accounts of a nineteenth-century shift from territorial expansion to commercial expansion, Richard W. Maass argues that US ambitions were selective from the start. By presenting twenty-three case studies, Maass examines the decision-making of US leaders facing opportunities to pursue annexation between 1775 and 1898. US presidents, secretaries, and congressmen consistently worried about how absorbing new territories would affect their domestic political influence and their goals for their country. These leaders were particularly sensitive to annexation's domestic costs where xenophobia interacted with their commitment to democracy: rather than grant political representation to a large alien population or subject it to a long-term imperial regime, they regularly avoided both of these perceived bad options by rejecting annexation. As a result, US leaders often declined even profitable opportunities for territorial expansion, and they renounced the practice entirely once no desirable targets remained. In addition to offering an updated history of the foundations of US territorial expansion, The Picky Eagle adds important nuance to previous theories of great-power expansion, with implications for our understanding of US foreign policy and international relations.

Challenging the traditional idea that voters identify with a political party out of blind emotional attachment, this pioneering book explains why party identification in contemporary American politics enables voters to make coherent policy choices. Standard approaches to the study of policy-based voting hold that voters choose based on the policy positions of the two candidates competing for their support. This study demonstrates that candidates can get a premium in support from the policy reputations of their parties. In particular, Paul Sniderman and Edward Stiglitz present a theory of how partisans take account of the parties' policy reputations as a function of the competing candidates' policy positions. A central implication of this theory of reputation-centered choices is that party identification gives candidates tremendous latitude in their policy positioning. Paradoxically, it is the party supporters who understand and are in synch with the ideological logic of the American party system who open the door to a polarized politics precisely by making the best-informed choices on offer.
