This book was released on 2023-06-25 with total page 275 pages. Available in PDF, EPUB and Kindle. Book excerpt: The United States is blessed with thousands of institutions of post secondary education. Integrity is alive at all levels. Learning takes place. American higher education is a stupendous achievement with a proud tradition. No area in the world is likely to claim better schools and a better record. Hundreds of small institutions with less than 1000 students, some public, some private, independent, some denominational, some comprehensive, others program selective, represent and live the spirit of a community of learning. But it is also true that the system of American higher education, just as American democracy, is confronted with challenges and threats. As the the Secretary of the U.S. Department of Education has recently, in August 2022, observed, “ The system was never completely right-side up”. He talked of a “post-secondary purgatory”, of a ranking system that is “a joke”, and called for a “cultural change in higher education, NOW”. These challenges and threats need to be addressed now, while it is still, hopefully, time to avert potentially catastrophic consequences. Just as democratic institutions are likely to be misused and need constant critical vigilance, so educational institutions need , active, constant attention and engaged maintenance. The experiences described in these chapters, while accurate, do not reflect comprehensively the “state of post-secondary American education”. But glaring defects and negative tendencies do exist and continue at all levels and to a degree that demands informed awareness and action. The quantitative leap in the student population after 1945 accelerated positive and negative developments. Opportunity of education is available, but hardly equal opportunity. Higher education seems to have become unduly influenced by interests and considerations destructive of quality education. Changes need to be considered and consensually implemented now in order to minimize intended and unintended negative consequences.

Sexual Harassment in the Workplace, Fourth Edition, is a comprehensive guide that provides all the information you need to successfully litigate a sexual harassment claim. Sexual Harassment in the Workplace guides you through the relevant administrative and legal proceedings, from client interviews to attorney's fees. It discusses state and federal remedies available to maximize recovery, including: The development and elements of the claim Sample pleadings Discovery documents Reviews of actual cases Special attention is given to important topics such as: Suits by alleged harassers Insurance indemnification Class actions And many others Sexual Harassment in the Workplace brings you up to date on the latest case law developments, including the following: A new checklist of items to cover when representing an employer The U.S. Supreme Court confirmed that retaliation is actionable under Title IX where a girls' high school basketball coach claimed that he suffered retaliation for complaining about sexual discrimination in the athletic program of the school, even though he himself was not the direct victim. Jackson v. Birmingham Board of Education, 544 U.S. 167 (2005) In order to increase opportunities for mediation, the EEOC expanded the charges eligible for mediation and now mediation is available at the conciliation stage, after a finding of discrimination has been issued, in appropriate cases The U.S. Supreme Court has held that under the Federal Arbitration Act, where parties to an arbitration agreement include a provision that delegates to the arbitrator the threshold question of enforceability of the arbitration agreement, if a party specifically challenges the enforceability of the entire agreement, the arbitrator would consider the challenge. If, however, the party only challenges the enforceability of the arbitration provision, the challenge must be heard by a court. Rent-A-Center, West Inc. v. Jackson, 130 S. Ct. 2772 (2010) The lack of timeliness in filing a discrimination action is an affirmative defense and the burden of proof is on the employer. Salas v. Wisconsin Department of Corrections, 493 F.3d 913, 922 (7th Cir 2007) A federal employee's premature filing of a sexual harassment employment discrimination and retaliation complaint did not constitute a failure to exhaust administrative remedies so as to deprive the district court of subject-matter jurisdiction. Brown v. Snow, 440 F.3d 1259 (11th Cir. 2006) A majority of states impose a shorter period for filing with their agencies, though, so the filing deadline is not always extended when a state has its own agency The andquot;single filing ruleandquot; - under which a party who has not filed an EEOC charge or received a right-to-sue notice may andquot;piggybackandquot; his or her judicial action on the claim of a party who has satisfied those prerequisites - has been described as a andquot;carefully limited exceptionandquot; to Title VII's procedural requirements. Price v. Choctaw Glove and Safety Co., 459 F.3d 595 (5th Cir. 2006) Provided that an act contributing to the claim occurs within the filing period, the court may consider the entire period of the hostile environment for purposes of determining liability. Jordan v. City of Cleveland, 464 F.3d 584 (6th Cir. 2006) The Supreme Court has held that a plaintiff's timely filing of an EEOC intake questionnaire, which was followed by an affidavit stating andquot; Please force Federal Express to end their age discrimination . . .andquot; constituted a charge, cautioning, however, that its permissiv

Available in PDF, EPUB and Kindle. Book excerpt: An in-depth look at America's changing gay neighborhoods Gay neighborhoods, like the legendary Castro District in San Francisco and New York's Greenwich Village, have long provided sexual minorities with safe havens in an often unsafe world. But as our society increasingly accepts gays and lesbians into the mainstream, are "gayborhoods" destined to disappear? Amin Ghaziani provides an incisive look at the origins of these unique cultural enclaves, the reasons why they are changing today, and their prospects for the future. Drawing on a wealth of evidence—including census data, opinion polls, hundreds of newspaper reports from across the United States, and more than one hundred original interviews with residents in Chicago, one of the most paradigmatic cities in America—There Goes the Gayborhood? argues that political gains and societal acceptance are allowing gays and lesbians to imagine expansive possibilities for a life beyond the gayborhood. The dawn of a new post-gay era is altering the character and composition of existing enclaves across the country, but the spirit of integration can coexist alongside the celebration of differences in subtle and sometimes surprising ways. Exploring the intimate relationship between sexuality and the city, this cutting-edge book reveals how gayborhoods, like the cities that surround them, are organic and continually evolving places. Gayborhoods have nurtured sexual minorities throughout the twentieth century and, despite the unstoppable forces of flux, will remain resonant and revelatory features of urban life.

Available in PDF, EPUB and Kindle. Book excerpt: Diversity these days is a hallowed American value, widely shared and honored. That’s a remarkable change from the Civil Rights era—but does this public commitment to diversity constitute a civil rights victory? What does diversity mean in contemporary America, and what are the effects of efforts to support it? Ellen Berrey digs deep into those questions in The Enigma of Diversity. Drawing on six years of fieldwork and historical sources dating back to the 1950s and making extensive use of three case studies from widely varying arenas—housing redevelopment in Chicago’s Rogers Park neighborhood, affirmative action in the University of Michigan’s admissions program, and the workings of the human resources department at a Fortune 500 company—Berrey explores the complicated, contradictory, and even troubling meanings and uses of diversity as it is invoked by different groups for different, often symbolic ends. In each case, diversity affirms inclusiveness, especially in the most coveted jobs and colleges, yet it resists fundamental change in the practices and cultures that are the foundation of social inequality. Berrey shows how this has led racial progress itself to be reimagined, transformed from a legal fight for fundamental rights to a celebration of the competitive advantages afforded by cultural differences. Powerfully argued and surprising in its conclusions, The Enigma of Diversity reveals the true cost of the public embrace of diversity: the taming of demands for racial justice.

Available in PDF, EPUB and Kindle. Book excerpt: In April 1983, a dynamic, multiracial political coalition did the unthinkable, electing Harold Washington as the first Black mayor of Chicago. Washington's victory was unlikely not just because America's second city was one of the nation's most racially balkanized but also because it came at a time when Ronald Reagan and other political conservatives seemed resurgent. Washington's initial win and reelection in 1987 established the charismatic politician as a folk hero. It also bolstered hope among Democrats that the party could win elections by pulling together multiracial urban voters around progressive causes. Yet what could be called the Washington era revealed clear limits to electoral politics and racial coalition building when decoupled from neighborhood-based movement organizing. Drawing on a rich array of archives and oral history interviews, Gordon K. Mantler offers a bold reexamination of the Harold Washington movement and moment. Taking readers into Chicago's street-level politics and the often tense relationships among communities and their organizers, Mantler shows how white supremacy, deindustrialization, dysfunction, and voters' own contradictory expectations stubbornly impeded many of Washington's proposed reforms. Ultimately, Washington's historic victory and the thwarted ambitions of his administration provide a cautionary tale about the peril of placing too much weight on electoral politics above other forms of civic action—a lesson today's activists would do well to heed.
