Book excerpt: Al consolidamento delle istituzioni e degli strumenti di cooperazione internazionale nel campo della tutela dei diritti umani si è accompagnato un ampio dibattito sui vincoli imposti alla sovranità degli Stati, del quale sono protagoniste le istanze giurisdizionali create nel contesto delle Convenzioni internazionali e le Corti costituzionali. Il presente volume offre i risultati di una riflessione condotta da giuristi di diversa formazione, che dà atto di una sostanziale convergenza della giurisprudenza internazionale e interna nella interpretazione delle norme sui diritti umani, anche se in diverse pronunce delle Corti costituzionali viene ribadito il principio della preminenza della Costituzione e dell’identità nazionale sugli obblighi derivanti dalle Convenzioni. Con riferimento al contesto europeo, numerose relazioni si soffermano sul ruolo della Corte di giustizia dell’Unione europea nell’assicurare la tutela dei diritti dell’uomo, operando un confronto rispetto alla giurisprudenza della Corte di Strasburgo e auspicando un migliore coordinamento a livello istituzionale. Un importante progresso in questa direzione si potrà realizzare con l’adesione dell’Unione europea alla Convenzione europea dei diritti dell’uomo e delle libertà fondamentali, alla quale è finalizzato il Progetto di accordo tra Unione europea e Consiglio d’Europa riprodotto in Appendice.
