Download or read book Criminal Copyright written by Eldar Haber and published by Cambridge University Press. This book was released on 2018-08-16 with total page 299 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the birth of criminal copyright in the nineteenth century, the copyright system has blurred the distinction between civil and criminal infringements. Today, in many jurisdictions, infringement of copyrighted materials can result in punitive fines and even incarceration. In this illuminating book, Eldar Haber analyzes the circumstances, justifications, and ramifications of the criminalization process and tells the story of how a legal right in the private enforcement realm has become over-criminalized. He traces the origins of criminal copyright legislation and follows the movement of copyright criminalization and enforcement on local and global scales. This important work should be read by anyone concerned with the future of copyright and intellectual property in the digital era.

Available in PDF, EPUB and Kindle. Book excerpt: A Brookings Institution Press and the Organization of American States publication In the past 15 years, the nations of the Western Hemisphere have staged a remarkable revolution—in the way they trade with their neighbors. First, after decades of restrictive import policies, several countries began to liberalize their trade and investment regimes. Then, beginning a decade ago, numerous bilateral and sub-regional trade agreements were achieved, to serve as vital complements to domestic reforms and to foster trade flows among member countries. At the Second Summit of the Americas in 1998, negotiations among 34 democracies were launched to establish the Free Trade Area of the Americas (FTAA). This report takes stock of the remarkable progress to date in the development of free trade in the Western Hemisphere. It examines trade flows between countries in the same regional groupings and between members of different sub-regional arrangements. The report describes the main characteristics of the trade arrangements signed between countries of the Hemisphere and explores the development of trade rules in these arrangements. Finally, the report details recent advances in the construction of the FTAA.

Download or read book Internet and the Law written by Aaron Schwabach and published by Bloomsbury Publishing USA. This book was released on 2014-01-15 with total page 1440 pages. Available in PDF, EPUB and Kindle. Book excerpt: The world of Internet law is constantly changing and is difficult to follow, even for those for whom doing so is a full-time job. This updated, everything-you-need-to-know reference removes the uncertainty. Internet and the Law: Technology, Society, and Compromises, Second Edition is the go-to source for anyone who needs clear explanations of complex legal concepts related to online practices and content. This wide-ranging, alphabetical reference explores diverse areas of law, including territorial jurisdiction and taxation, that are relevant to or affected by advances in information technology and the rise of the Internet. Particular emphasis is placed on intellectual property law and laws regarding freedom of expression. The Internet, as this book shows, raises questions not only about how to protect intellectual creations, but about what should be protected. Entries also discuss how the Web has brought First Amendment rights and free expression into question as society grapples with attempts to control "leaks" and to restrict content such as pornography, spam, defamation, and criminal speech.
Book Synopsis Pluralism or Universalism in International Copyright Law by : Tatiana Eleni Synodinou
Download or read book Pluralism or Universalism in International Copyright Law written by Tatiana Eleni Synodinou and published by Kluwer Law International B.V.. This book was released on 2019-10-24 with total page 594 pages. Available in PDF, EPUB and Kindle. Book excerpt: In a world where powerful intermediaries like Google and Facebook are de facto regulators of the communication of copyright-protected works, the democratization of access to content has both substantially expanded the availability of new markets and dramatically increased copyright infringements. Does this mean that the long-sought ideal of a “universal” copyright regulation, which would harmoniously combine effective protection of intellectual creations with public interest goals, is a lost cause? Taken together, the contributions to this insightful and thoroughly researched book suggest that despite the prevailing labyrinthine mosaic of divergent national responses to fragmentation at international level, the foundations of a universal approach can be found in the interaction of regional, national and international copyright law instruments when responding to current and emerging technologies. Emphasizing the adaptation of copyright law to the needs of the information society, this volume provides critical approaches by leading copyright scholars on whether pluralism or universalism is the appropriate path to follow for the development of international copyright law. The authors deal with such issues and topics as the following: the application of core copyright law principles worldwide; authorship, rights and exceptions in the international copyright acquis; Internet copyright enforcement; global collective management of copyright; copyright contracts; database and design rights; intermediary liability; the global reach of the U.S. Fair Use doctrine; World Intellectual Property Organization’s role and strategy in international copyright lawmaking; and bilateral trade and investment agreements involving copyright. Specific evolutions and emerging trends in national and regional digital copyright laws are analyzed and assessed as they have developed in the European Union, the United States, Canada and Australia, as well as in several Asian and African countries. Throughout, attention is paid to compatibility with the Berne Convention, the perceived core of copyright law in the international copyright acquis, and the key question of the balancing of copyright law with fundamental rights from an international and comparative law perspective. As a comprehensive analysis of how core copyright law concepts and principles function in today’s fragmented copyright legal system, this book has no peers. Its detailed treatment of numerous specific instruments and regimes, as well as its insightful approaches to the future of international copyright lawmaking, will prove of immeasurable value to lawyers, judges, policy makers, academics and researchers working in the field of copyright law.

Download or read book Intellectual Property written by Aaron Schwabach and published by Bloomsbury Publishing USA. This book was released on 2007-04-26 with total page 337 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the history of the concepts of intellectual property and the current state of U.S. and international intellectual property law. In this timely and readable volume, law professor Aaron Schwabach explores the three traditional categories of intellectual property—copyright, patent, and trademark. He traces their historical development from medieval times to the present and observes how intellectual property law has responded to successive waves of technological change. Intellectual Property examines all sides of current controversies and crises in this fast-changing field, particularly those resulting from the digital information revolution. Because ideas are not constrained by national borders, the author focuses on intellectual property, including trade secrets, as an international phenomenon, emphasizing the experiences and contributions of a wide variety of countries and cultures. An essential resource for students and researchers—and anyone else who needs to know how to use and/or protect intellectual property.
