Book excerpt: This book is About the Science of Public Administration about what we know and what we need to know about it, as well as what we can do to make science more useful to the state and society. The disarticulation between the Science of Public Administration and the administrative practice of the XXI century causes that the public administrator does not have the theoretical elements and the sufficient tools for the efficient and effective treatment of public affairs. The administration Public and its science have to be rethought not only from their inheritance, but also from their potential to provide intellectual tools and practices that increase public capacity. That is ,make a stronger, smarter and more efficient state, which can only be achieved with a solid and useful body of knowledge. From the detailed study of the State, the Science of Public Administration and its practice, facing the current needs of the governments, the autor proposes elements for its consolidation and strengthening in the XXI century.

Available in PDF, EPUB and Kindle. Book excerpt: Judicial control of public power ensures a guarantee of the rule of law. This book addresses the scope and limits of judicial control at the national level, i.e. the control of public authorities, and at the supranational level, i.e. the control of States. It explores the risk of judicial review leading to judicial activism that can threaten the principle of the separation of powers or the legitimate exercise of state powers. It analyzes how national and supranational legal systems have embodied certain mechanisms, such as the principles of reasonableness, proportionality, deference and margin of appreciation, as well as the horizontal effects of human rights that help to determine how far a judge can go. Taking a theoretical and comparative view, the book first examines the conceptual bases of the various control systems and then studies the models, structural elements, and functions of the control instruments in selected countries and regions. It uses country and regional reports as the basis for the comparison of the convergences and divergences of the implementation of control in certain countries of Europe, Latin America, and Africa. The book’s theoretical reflections and comparative investigations provide answers to important questions, such as whether or not there are nascent universal principles concerning the control of public power, how strong the impact of particular legal traditions is, and to what extent international law concepts have had harmonizing and strengthening effects on internal public-power control.

Book excerpt: Inter and Intra Governmental Arrangements for Productivity - An Agency Approach focuses on public productivity. It addresses long standing and current questions on government productivity. Its scope and coverage range from theory to very specific applications. First of all it demonstrates the applicability of a theoretical framework to concrete issues in the public sector: the Principal Agent (PA) theory or the Agency theory. Secondly, it demonstrates the different perspectives of this theoretical framework as seen by researchers and practitioners from various countries. The volume is based upon the revised seminar papers from a conference that was held at the University of Twente. Two trends obvious in this world are its increasing global character and the need for increasingly efficient and effective organizations. Inter and intra governmental organizations need to learn to effectively and efficiently work together in complex web like relationships. This study forms a major step in that direction. It consolidates several current economic concepts that are highly visible and specifically applies them to various levels and functions of government. It emphasizes that PA theory is a powerful conceptual framework because of the economic focus on transactions between principals and agents. The issues of information asymmetry, across government constituents, political/diplomatic considerations, and the narrow focus of PA problems will be described. Attention is also given to the issues of citizen demands, internal markets, franchising, competitive procurement and `contracting in'. The study concentrates on academic thinking about the applicability of PA concepts to administrative theory building. As such it makes a current, valid contribution to the knowledge and practice of public administration world-wide.

It provides a comprehensive overview of how policy actors, including politicians, think tanks, researchers, interest groups and experts, generate information for the policy-making process. The book explores how executive and legislative actors participate in the production of policy analysis and how all actors elaborate and disseminate information on policy analysis. Contributors consider the ways different policy actors are involved in the production of data and information about policy problems, the resources used to produce policy analysis and the type of analysis produced over time in different policy areas.

Available in PDF, EPUB and Kindle. Book excerpt: In today’s increasingly complex and uncertain business environment, financial analysis is yet more critical to business managers who tackle problems of an economic or business nature. Knowledge based on formal logic and even experience becomes less sufficient. This volume systematically sets out the basic elements on which to base financial analysis for business in the new century. It incorporates a previous work that can serve as the basis and foundation for the new contributions that are now being made in the field of financial economy and intend to provide business with instruments and models suitable for dealing with the new economic context. In dealing with rapid and unpredictable changes in technological and business conditions, it postulates a growing reliance on the opinions of experts instead of past data or probabilistic forecasts, which is a radical change but may yield fruitful results. For this reason, much emphasis is devoted to the problem of aggregation of the opinion of experts in the financial field, with the object of limiting, wherever possible, the subjective component of the opinions and making sure that the decisions have the best guarantee of reaching the desired objectives.

Available in PDF, EPUB and Kindle. Book excerpt: The Max Planck Handbooks in European Public Law series describes and analyses the public law of the European legal space, an area that encompasses not only the law of the European Union but also the European Convention on Human Rights and, importantly, the domestic public laws of European states. Recognizing that the ongoing vertical and horizontal processes of European integration make legal comparison the task of our time for both scholars and practitioners, it aims to foster the development of a specifically European legal pluralism and to contribute to the legitimacy and efficiency of European public law. The first volume of the series begins this enterprise with an appraisal of the evolution of the state and its administration, with cross-cutting contributions and also specific country reports. While the former include, among others, treatises on historical antecedents of the concept of European public law, the development of the administrative state as such, the relationship between constitutional and administrative law, and legal conceptions of statehood, the latter focus on states and legal orders as diverse as, e.g., Spain and Hungary or Great Britain and Greece. With this, the book provides access to the systematic foundations, pivotal historic moments, and legal thought of states bound together not only by a common history but also by deep and entrenched normative ties; for the quality of the ius publicum europaeum can be no better than the common understanding European scholars and practitioners have of the law of other states. An understanding thus improved will enable them to operate with the shared skills, knowledge, and values that can bring to fruition the different processes of European integration.
