La présente thèse tend à montrer qu'au stade de leur formation, les objectifs multiples assignés aux contrats de la commande publique, particulièrement l'ouverture à la concurrence, les empêchent d'être des vecteurs efficaces d'innovation. En effet, les instruments dédiés à l'innovation, que sont notamment le partenariat d'innovation, les variantes, ou les dérogations liées à l'achat innovant, voient leur potentiel entravé par une application stricte des principes de la commande publique qui sous-tendent la mise en concurrence (égalité de traitement, liberté d'accès et transparence). Il appartient en revanche aux parties de construire leur relation contractuelle en tenant compte des caractéristiques de l'innovation, telles que l'évolutivité et la performance. C'est donc le contrat, en tant qu'instrument d'anticipation, qui constitue un promoteur efficace de l'innovation. La présente thèse est à jour des réformes récentes du droit de la commande publique, principalement la codification du Code de la commande publique en 2019 et les nouveaux modèles de CCAG publiés en 2021.

Enfin, en assouplissant les conditions d’une coopération entre la recherche publique et le secteur industriel et en créant les conditions juridiques et fiscales favorables aux entreprises innovantes, l’on peut même affirmer que la réforme a constitué une « soft revolution » à l’égard du dispositif antérieur.
