Organisations including Consumer Focus Wales and Citizens Advice represent consumers' interests in their dealings with businesses, industry regulators and the UK and Welsh Governments. A significant aspect of their work is to ensure that consumers receive a fair deal in their daily lives. Advocacy is particularly important to those termed the most vulnerable in Welsh society. The Government announced its plans in October 2010 to abolish Consumer Focus Wales and to transfer some or all of its functions to Citizens Advice Cymru. The final decision will be taken once Ministers have considered the findings of the public consultation. But this delay has caused on going uncertainty and the Committee calls on the Government to publish without delay its detailed plans. MPs are not wholly persuaded by the Government's reasons for abolishing Consumer Focus Wales, but recognise that given the current financial situation there is a strong case for examining whether consumer interests are represented in the most efficient and cost-effective way. However, the Government should provide guarantees that the best features of Consumer Focus Wales are protected in any successor body, including: statutory independence from interference by ministers or its parent organization; a "Welsh focus" and the present level of funding. As consumer matters fall increasingly under the responsibility of the National Assembly for Wales, the committee calls for a review, on whether to devolve responsibility for consumer affairs to the National Assembly for Wales and that The Commission on Devolution in Wales should consider this matter when it reviews the powers of the National Assembly for Wales

Book excerpt: The Government's draft Consumer Rights Bill has the potential to consolidate, simplify and modernise consumer law however issues and inconsistencies must be resolved. The current proposals would apply a statutory right that services under a contract must be provided with reasonable care and skill [a fault-based standard]. This does not provide sufficient consumer protection. The Draft Bill should require that services must achieve the stated result, or one which could be reasonably expected [an outcomes-based standard]. As the Bank of Ireland case demonstrated, the right to terminate a contract does not necessarily protect consumers from detriment. This report recommends an addition to the grey list - the indicative list of contract terms which may be regarded as unfair. The Government's proposals for enhanced consumer measures, which would require traders that have breached consumer law to compensate consumers, are welcome. However, private enforcers should also be able to use them. The collective proceedings regime has the potential to improve access to redress for victims of competition law breaches but the Government must clarify the certification requirements for such proceedings. The creation of rights and remedies for digital content is welcome, but the Government must do more to communicate how the proposals will work in practice. Under the draft Bill, the remedies available to consumers of digital content would depend on whether the content is intangible (such as a music download) or tangible (such as a CD). In appropriate circumstances, consumers should have the right to reject and obtain a refund irrespective of whether they purchase intangible or tangible digital content

These controversial and risky offerings had an equivalent in numerous hire purchase agreements, with which new homes were furnished. Such developments were forerunners of the 'easy credit' regime more commonly associated with the 1980s. Taking a long-term perspective on this issue indicates that Britain's departure from European models of consumer credit markets was not simply a by-product of neoliberalism's influence on the Thatcher administration, and this book offers a much fuller explanation to the phenomenon. It explores debates within and between the major political parties; reveals the infighting amongst civil service departments over management of consumer demand; charts the varying degrees of influence wielded by the Bank of England and finance capital, as opposed to that of consumer durable manufacturers; reviews the perspectives of consumers and their representatives; and explains the role of contingency and path dependency in these historical events. The central focus of this book is on consumer credit, but this subject provides a case study through which to explore numerous other important areas of British history. These include debates on the issues of post-war consensus, the impact of rising home ownership and its impact on consumer credit and personal finance markets, the management of consumer society, political responses to affluence, the development of consumer protection policy, and the influence of neoliberalism.
