Book excerpt: The Consumer Protection from Unfair Trading Regulations 2008 (the Regulations) prohibit misleading and aggressive trade practices. The Regulations implemented a European directive, replacing 23 previous UK consumer protection measures, including most of the Trade Descriptions Act 1968. They are enforced mainly by the Office of Fair Trading and by trading standards services. Under current law, consumers do not have a right to compensation if a trader breaches the Regulations. Instead consumers must rely on a variety of private causes of action: some statutory, some based on case law. These are complex, confusing and patchy. This Consultation Paper aims to: (1) simplify redress for misleading commercial practices; (2) simplify redress for aggressive commercial practices; and (3) fill gaps in protection, where a consumer is unable to gain redress for serious breaches of the Regulations.

Book excerpt: This book advances the emergence of a new sub-field of study, the law of consumer redress, which encompasses the various dispute resolution processes for consumers, their regulations, and best practices. The book argues that the institutionalisation of alternative dispute resolution (ADR) bodies are expanding their functions beyond dispute resolution, as they are increasingly providing a public service for consumers that complements, and often replaces, the role of the courts. Although the book focuses on ADR, it also analyses other redress methods, including public enforcement, court adjudication and business internal complaints systems. It proposes a more efficient rationalisation of certified redress bodies, which should be better co-ordinated and accessible through technological means. Accordingly, the book calls for greater integration amongst redress methods and offers recommendations to improve their process design to ensure that, inter alia, traders are encouraged to participate in redress schemes, settle early meritorious claims and comply with outcomes.

This book was released on 2018-07-17 with total page 384 pages. Available in PDF, EPUB and Kindle. Book excerpt: Consumer protection has become the topic of debate at all levels. The reason behind this has been the lack of awareness of consumers and the malpractices of the business world. In order to maximize profits, many businessmen exploit consumers by supplying poor qual-ity goods at higher prices. They adopt unfair trade practices such as adulteration, boarding, black-marketing, etc. As a result, consumers do not get value for their money. Big business houses use their power for private gain and to the detriment of consumers. Consumers are exposed to physical, environmental and other hazards. They need to be protected from spurious, duplicate and adulterated products, pollution of air, water and noise, and misleading advertising. Consumer protection, however, is only possible if two steps are taken. First is to frame rules, legislations and set up machinery like courts to assure that laws are implemented in their true spirits. Second is to make the stakeholders aware of such laws so that they might defend themselves when required. Keeping these two steps in mind, this study has been undertaken. It covers the evaluation of consumer protection machinery and assesses the level of awareness of consumers in Himachal Pradesh. A brief outline of the thesis is as below. Chapter - I deals with the introduction to consumer protection. It discusses the meaning of consumer, consumer protection, and consumerisms. It also discusses the consumer's rights, needs, and consumer's responsibilities. Chapter - II reviews the literature concerning the problem at hand. It also presents a picture of research design formulated for the present research work. It discusses the selection of the problem, importance, scope, objectives, hypotheses and research methodology of the present study. Finally, the limitations and the future scope of study have been shown. Chapter - III discusses consumerism and consumer protection movements at the international and national level. Chapter - IV is an attempt to examine various legislations for consumer protection at the international level as well at the national level in India. Chapter - V reviews the frameworks for consumer dispute resolution and redress in India. Chapter - VI examines the organizational setup for the consumer protection along with its evaluation in Himachal Pradesh. Chapter - VII deals with the analyses of opinion and perception about consumer awareness and consumer alertness with regard to consumer protection. Chapter - VIII highlights the summary and major findings of the study. It also explains suggestions to improve the implementation of consumer protection laws and awareness among people.

Available in PDF, EPUB and Kindle. Book excerpt: Online auctions have undergone many transformations and continue to attract millions of customers worldwide. However these popular platforms remain understudied by legal scholars and misunderstood by legislators. This book explores the legal classification of online auction sites across a range of countries in Europe. Including empirical studies conducted on 28 online auction websites in the UK, the research focusses on the protection of consumers’ economic rights and highlights the shortcomings that the law struggles to control. With examinations into important developments, including the Consumer Rights Directive and the latest case law from the CJEU on the liability of intermediaries, Riefa anticipates changes in the law, and points out further changes that are needed to create a safe legal environment for consumers, whilst preserving the varied business model adopted by online auction sites. The study provides insights into how technical measures as well as a tighter legislative framework or enforcement pattern could provide consumers with better protection, in turn reinforcing trust, and ultimately benefiting the online auction platforms themselves.

Book excerpt: The Routledge Handbook of Consumer Protection and Behaviour in Energy Markets provides a comprehensive study of consumer protection and consumer behaviour in selected jurisdictions worldwide. Each chapter is written by experts and provides a contemporary overview of national consumer protection and policy developments in the energy sector. Today energy has become an essential factor in ensuring the socio-economic development of any country and improving the quality of life of society and is now an essential element of life for everyone. The energy market has become a competitive market, based on the assumption that generation and sale of energy is not a natural monopoly and that market mechanisms, in particular competition between energy companies, are the best way to reduce prices and improve customer service. The purchase of energy is inextricably linked with its distribution from the producer to the purchaser. The book shows that well-functioning energy markets need informed and well protected consumers, who can benefit from competition and transparent offers. They are free to choose the most competitive providers, and know their rights, with access to effective means of redress. Given that the energy market has a specific, technical nature, the book analyses the energy market within the scope of free market principles, with a focus on the protection of the weaker party to the contract: the consumer. In addition, consumers can also play an active part of the clean energy transition.

Available in PDF, EPUB and Kindle. Book excerpt: This book looks at the consumer protection offered in a range of Asian countries, for example China, Japan, and South Korea in key areas such as consumer sales law, unfair terms, product liability, and unfair commercial practices. However, it is interesting to note that consumer protection is on the rise everywhere and to compare how this differs depending upon the legal cultures. It is also fascinating to reflect on the influence of models for law reform such as the EU laws. ASEAN has also affected the development of consumer policy for its member states. The book takes the form of national reports which explain the development of the law and also shed light on how the law works in practice. The book also contains thematic reports which look at each area of the law from a comparative perspective. Commentators from around the globe reflect on their impression of Asian consumer law based on their own differing legal systems and benchmarks. A must-read for anyone with an interest in consumer law in Asia and beyond, this book will form the basis of further research and discussion internationally.
