Book Synopsis Updating the UN Guidelines for Consumer Protection for the Digital Age by : Jeremy Malcolm
Download or read book Updating the UN Guidelines for Consumer Protection for the Digital Age written by Jeremy Malcolm and published by Consumers International. This book was released on 2013-06-01 with total page 113 pages. Available in PDF, EPUB and Kindle. Book excerpt: The United Nations Guidelines for Consumer Protection are an influential declaration of best practices in consumer protection law and policy. But as they were last amended in 1999, they are now overdue for an update - not least in areas where advances in technology have affected consumers, such as access to knowledge, Internet and telecommunications services, e-commerce, and digital products and services. Consumers International (CI), as the global campaigning voice for consumers, is well placed to make recommendations about what amendments should be made to address these new and emerging areas of consumer rights. This publication - which is a companion volume to a broader set of amendments developed by CI - explains our reasoning behind those proposed amendments that particularly affect consumers in the digital age. A focus of this volume - and of the Guidelines themselves - is on how effective consumer laws and policies can benefit consumers in developing and emerging economies. As such, in-depth analysis is provided of how the proposed amendments relate to consumers in India, Brazil and South Africa, either by reflecting existing best practices in those countries, or by shining light on problem areas that the proposed amendments could help address.

Available in PDF, EPUB and Kindle. Book excerpt: This is a time of extraordinary change: technology is transforming interpersonal and business communication, including marketing and advertising to consumers. Products are evolving as a result of innovation. Even the way consumers are paying for goods and services is being revolutionised, as electronic payment systems serve up new and inventive ways to exchange money. Increasingly, people of all ages are using wireless phones and devices for communicating, for information gathering, and for entertainment- in all types of locations. And, as new wireless technologies are introduced, so too are new and expanded ways to get information and be entertained via your wireless phone or device. This book examines ways to adapt consumer protection strategies to ensure that all consumers, including the vulnerable, are equally well served. Applying existing policies and creating new ones is also looked at to address emerging challenges regarding new technologies and products that may be unfamiliar to consumers. This book also discusses how the ever-expanding number of marketing channels in the world-wide marketplace will be monitored for instances of deception of unfairness and finally, the collaboration with law enforcers from around the world will be examined to protect consumers in the global marketplace.

Book Synopsis International Perspectives on Consumers' Access to Justice by : Charles E. F. Rickett
Download or read book International Perspectives on Consumers' Access to Justice written by Charles E. F. Rickett and published by Cambridge University Press. This book was released on 2003-03-20 with total page 444 pages. Available in PDF, EPUB and Kindle. Book excerpt: Consumer protection law in the age of globalisation poses new challenges for policy-makers. This book highlights the difficulties of framing regulatory responses to the problem of consumers' access to justice in the new international economy. The growth of international consumer transactions in the wake of technological change and the globalisation of markets suggests that governments can no longer develop consumer protection law in isolation from the international legal arena. Leading scholars consider the broader theme of access to justice from socio-legal, law and economics perspectives. Topics include standard form contracts, the legal challenges posed by mass infections (such as mad-cow disease and CJD), ombudsman schemes, class actions, alternative dispute resolution, consumer bankruptcy, conflict of laws, and cross-border transactions. This book demonstrates that advancing and achieving access to justice for consumers proves to be a challenging, and sometimes elusive, task.

Book Synopsis Privacy and the Commercial Use of Personal Information by : Paul H. Rubin
Download or read book Privacy and the Commercial Use of Personal Information written by Paul H. Rubin and published by Springer Science & Business Media. This book was released on 2002 with total page 128 pages. Available in PDF, EPUB and Kindle. Book excerpt: Hon. Orrin G. Hatch United States Senate Electronic commerce will be pivotal to the United States economy in the 21 SI Century. With the advent ofelectronic commerce, some consumers have become concerned about the disclosure, transfer, and sale of information which businesses have collected about them. These concerns purportedly are slowing the rate ofexpansion ofelectronic commerce, thereby putting at risk the future growth of the New Economy. To reduce this risk, a variety of schemes have been proposed under which the government would regulate online privacy. Congress currently is in the midst ofa vigorous debate as to whether the government should regulate on-line privacy standards, and, ifso, what form such regulation should take. This succinct yet powerful book by Paul Rubin and Thomas Lenard goes to the heart of these issues. It explains that there is no evidence of actual consumer harm or market failure that could justify burdensome government regulation of online privacy. It describes the tremendous advantages consumers currently receive from the free flow of information collected on line, advantages which could be eliminated if the government unnecessarily regulates and stops this flow of information. It argues that the free market provides businesses with compelling incentives to adopt their own measures - such as seal programs and novel technologies - to assuage consumer privacy concerns. This book presents compelling evidence to support these and many other points central to the continuing debate in the halls of Congress and elsewhere concerningonline privacy.

Book Synopsis Guidelines for Consumer Protection in the Context of Electronic Commerce by : Organisation for Economic Co-operation and Development

This book was released on 2000-03-15 with total page 48 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Guidelines for Consumer Protection in the Context of Electronic Commerce are designed to help ensure that consumers are no less protected when shopping on line than they are when they buy from their local store or order from a catalogue. By setting out the core characteristics of effective consumer protection for online business-to-consumer transactions, the Guidelines are intended to help eliminate some of the uncertainties that both consumers and businesses encounter when buying and selling on line. The Guidelines reflect existing legal protections available to consumers in more traditional forms of commerce. Their aim is to encourage: - fair business, advertising and marketing practices; - clear information about an online business’s identity, the goods or services it offers and the terms and conditions of any transaction; - a transparent process for the confirmation of transactions; - secure payment mechanisms; - fair, timely and affordable dispute resolution and redress; - privacy protection; and - consumer and business education.

Book Synopsis Consumer Theories of Harm by : Paolo Siciliani
Download or read book Consumer Theories of Harm written by Paolo Siciliani and published by . This book was released on 2019 with total page 224 pages. Available in PDF, EPUB and Kindle. Book excerpt: "It has long been thought that fairness in European Consumer Law would be achieved by relying on information as a remedy and expecting the average consumer to keep businesses in check by voting with their feet. This monograph argues that the way consumer law operates today promises a lot but does not deliver enough. It struggles to avoid harm being caused to consumers and it struggles to repair the harm after the event. To achieve fairness, solutions need to be found elsewhere. Consumer Theories of Harm offers an alternative model to assess where and how consumer detriment may occur and suggests solutions to prevent it. It shows that a more confident use of economic theory will allow practitioners to demonstrate how a poor standard of professional diligence lies at the heart of consumer harm. The book provides both theoretical and practical examples of how to combine existing law with economic theory to improve case outcomes. It also shows how public enforcers can move beyond the dominant transparency paradigm to an approach where firms have a positive duty to treat consumers fairly and to shape their commercial offers in a way that prevents consumers from making mistakes. Over time, this ‘fairness-by-design’ approach will emerge as the only acceptable way to compete".
