Available in PDF, EPUB and Kindle. Book excerpt: This is the first book to offer a systematic and analytical overview of the legal framework for residential construction. In doing so, the book addresses two fundamental questions: Prevention: What assurances can the law give buyers (and later owners and occupiers) of homes that construction work – from building of a complete home to adding an extension or replacing a shower unit – will comply with minimum standards of design, safety and build quality? Cure: What forms of redress - from whom, and by what route - can residents expect, when, often long after completion of construction, they discover defects? The resulting problems pose some big and difficult questions of principle and policy about standards, rights and remedies, which in turn concern justice more generally. This book addresses these key issues in a comparative context across the United Kingdom, Ireland, Australia and New Zealand. It is an accessible guide to the existing law for residents and construction professionals (and their legal advisers), but also charts a course to further, meaningful reforms of the legal landscape for residential construction around the world. The book's two co-authors, Philip Britton and Matthew Bell, have taught in the field in the UK, Australia and New Zealand; both have been active in legal practice, as have the book's two specialist contributors, Deirdre Ní Fhloinn and Kim Vernau.

Book excerpt: ABSTRACT: Construction defect litigation has increased dramatically in the residential market in the past 20 years, particularly in the states bordering the Gulf of Mexico due to their high precipitation rates and high relative humidity. A review of the literature indicates that more than half (53%) of all construction defects are due to faulty workmanship, improper installation, or poor supervision of trade contractors. The workforce in the Gulf States increasingly consists of low English literacy workers employed by non-unionized construction companies that traditionally do not provide formalized craft training. The focus of this research study was to identify the extent to which lack of craft training may be responsible for moisture-related construction defects among the trades responsible for weather-proofing the building envelope. A survey was administered to more than 120 envelope trade contractors in the southeast United States (U.S.). Results indicated that 59% of the companies hired entry-level workers with little or no prior experience. Eighty-two percent of the companies stated they provided no formal training to workers. Fifty-four percent of the companies surveyed stated that their workers primarily spoke a language other than English.

This book was released on 2004 with total page 58 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Canada, home builders acquire protection via various forms of insurance, including, among others, builders risk insurance, wrap-up general liability insurance and contractors comprehensive general liability insurance. Together, these types of coverage, whether purchased on a project-by-project or continuous basis, not only provide builders with protection for loss and liability throughout and following construction projects but also act as a means of securing the interests of financial stakeholders associated with the project(s). This study was designed to satisfy the following key objectives: Ÿ Develop an understanding of the issues surrounding builders risk insurance; and Ÿ Develop an understanding of the issues surrounding post-construction liability insurance. Primary research for this study consisted of conducting nationwide interviews of residential construction companies, insurance underwriters and brokers, and associations and lending organizations, while secondary research consisted of documentation and literature reviews of previously published articles, research and proprietary association and company materials. According to the research conducted, the insurance market for all types of commercial coverage has hardened over the last three years. A "hard" market designates an environment characterized by rising prices and reductions in capacity to underwrite insurance. The market has reacted to the events of September 11, reductions in reinsurance capacity, poor underwriting results and a difficult investment climate. The insurance industry's appetite for insuring residential construction projects has been particularly weak in response to widely publicized catastrophic fires at construction sites at several different locations across Canada and the emergence of new risks such as mold and terrorism. The insurance market for residential construction is contracting, with lower risk tolerance and fewer companies participating in the market. Over the last three years, home builders have identified construction insurance as a critical problem area with reports of higher premiums and deductibles, reduced levels of coverage, new warranties and conditions attached to the policies, as well as refusals of coverage. These recent developments are a cause of concern in the housing industry with respect to the cost and availability of insurance. The cost of insurance ultimately affects housing affordability and the profitability of the home builders' business.
