This provides the basis for an examination of the contemporary understanding of the nature of its power and authority, as portrayed in the 1983 Code of Canon Law. The general chapter is analysed in terms of its juridic status, collegial nature, participative character and representative function as well as its dynamic aspects and faith dimension. The author applies the findings to one institute of consecrated life, Institute of the Blessed Virgin Mary Loreto Branch. Ours is "intended to endure for ages to come, and consequently, to be adapted to the various crises of human affairs." In recent years, Marshall's great truths have been challenged by proponents of originalism and strict construction. Such legal thinkers as Supreme Court Justice Antonin Scalia argue that the Constitution must be construed and applied as it was when the Framers wrote it. In Keeping Faith with the Constitution, three legal authorities make the case for Marshall's vision. To believe in this God of unconditional Love is a lived experience in each person and in each generation everywhere on the globe and all different cultures and historical periods. In the beginning of the nineteenth century we notice in the south of the Netherlands a strong movement to renew and to actualise the Catholic faith in the concrete circumstances of poverty and political neglect. In this way the Congregation of the Sisters of Charity Daughters of Mary and Joseph was founded on 7 July 1820 in ’s Hertogenbosch. Similar to several other congregations in the same period St Vincent de Paul was their principal source of inspiration, determined their charism and remained at the centre of their spirituality. Religious life is essentially a lived experience of faith in which concrete persons touched by the incomprehensible Love of God dedicate their life in total surrender to this Love. As a result, they obey to the divine calling to be wholly transformed in love and to become docile instruments of God’s overwhelming Charity towards all vulnerable persons - young and old – their brothers and sisters who are stripped of their human dignity, humiliated and enslaved in many subtle ways. In this Vincentian congregation this divine vocation of Charity was originally implemented as a specific service to the education of blind and deaf children but widened to the care of other forgotten groups like victims of trafficking in women and discrimination or subordination of women.

Four major practices are examined in this regard. First, Catholic schools deliberately set out to encourage pupils to join the ranks of the religious. Secondly, they replicated within the schools the authoritarianism of the religious life. Thirdly, they worked continuously to marginalize lay teachers from their decision-making. Finally, they were ever vigilant in their opposition to co-education and sex education. The contribution of the religious orders to Catholic education is recognized, but consideration is also given to child abuse, both physical and sexual, in whhich members of various religious teaching orders engaged. Vacher's methodology, comparing the congregation's theoretical, prescriptive documents with evidence about the actual life of these communities in southern France, leads to the question of whether and to what degree succeeding generations grasped the original inspiration.
