Book excerpt: Although enacted into law in four previous statutes, charitable choice has been the subject of persistent controversy; and President Bush's initiative in the 107th Congress led the controversy to become highly visible. The primary concerns have been the constitutionality and desirability of the federal government directly subsidising faith-based social service programs and whether subsidised religious organisations should be able to discriminate on religious grounds in their employment practices. This new book provides background and analysis on a number of the salient factual and legal issues about charitable choice, and also discusses the relationship of faith-based organisations with state and local governments.

Book excerpt: One of the most respected and influential scholars of religious liberty in our time, Douglas Laycock has argued many crucial religious-liberty cases in the United States Supreme Court. His noteworthy scholarly and popular writings are being collected in five comprehensive volumes under the title Religious Liberty. In this final volume Laycock documents the use of the Constitution’s Free Speech Clause and Establishment Clause in legal briefs, scholarly and popular articles, House testimonies, and written debates. These two clauses have been vitally important in religious-liberty cases concerning religious speech in schools, politics, and the workplace, government funding of religious schools and social services, and the meaning of separation of church and state.

Available in PDF, EPUB and Kindle. Book excerpt: President Obama has signaled a sharp break from many Bush Administration policies, but he remains committed to federal support for religious social service providers. Like George W. Bush’s faith-based initiative, though, Obama’s version of the policy has generated loud criticism—from both sides of the aisle—even as the communities that stand to benefit suffer through an ailing economy. God’s Economy reveals that virtually all of the critics, as well as many supporters, have long misunderstood both the true implications of faith-based partnerships and their unique potential for advancing social justice. Unearthing the intellectual history of the faith-based initiative, Lew Daly locates its roots in the pluralist tradition of Europe’s Christian democracies, in which the state shares sovereignty with social institutions. He argues that Catholic and Dutch Calvinist ideas played a crucial role in the evolution of this tradition, as churches across nineteenth-century Europe developed philosophical and legal defenses to protect their education and social programs against ascendant governments. Tracing the influence of this heritageon the past three decades of American social policy and church-state law, Daly finally untangles the radical beginnings of the faith-based initiative. In the process, he frees it from the narrow culture-war framework that has limited debate on the subject since Bush opened the White House Office for Faith-Based and Community Initiatives in 2001. A major contribution from an important new voice at the intersection of religion and politics, God’s Economy points the way toward policymaking that combines strong social support with a new moral focus on the protection of families and communities.

Book excerpt: The Collected Works on Religious Liberty comprehensively collects the scholarship, advocacy, and explanatory writings of leading scholar and lawyer Douglas Laycock, illuminating every major religious liberty issue from both theoretical and practical perspectives. / This first volume gives the big picture of religious liberty in the United States. It fits a vast range of disparate disputes into a coherent pattern, from public school prayers to private school vouchers to regulation of churches and believers. Laycock clearly and carefully explains what the law is and argues for what the law should be. He also reviews the history of Western religious liberty from the American founding to Protestant-Catholic conflict in the nineteenth century, using this history to cast light on the meaning of our constitutional guarantees. / Collected Works on Religious Liberty is unique in the depth and range of its coverage. Laycock helpfully includes both scholarly articles and key legal documents, and unlike many legal scholars, explains them clearly and succinctly. All the while, he maintains a centrist perspective, presenting all sides — believers and nonbelievers alike — fairly.

Book excerpt: This textbook explores ethical issues for not-for-profit and non-governmental organizations, providing discussion-oriented cases for NFP and NGP practitioners. The book begins with an introduction to professional ethics as practiced in industry, not-for-profits and NGO’s. Attention is paid both to classical ethical theories and contemporary variants. Then, combining that theory with an introduction to the morally unique facets of the NFP and NGO landscape, it offers a series of cases which pertain to the underlying theoretical substrate. The reader will find a blend of theory and application within the text as well as guided assignment prompts. Themes covered include board relationships, staff management, work with vulnerable populations, financial transparency, Human Resources ethics and ethical dilemmas unique to international operations.
