Book excerpt: The Committee recognises the appetite in many quarters for fundamental constitutional change and welcomes the Government's renewed focus on constitutional reform and renewal in response to this. It is surprised by the limited provisions in the Constitutional Reform and Governance Bill, and fears that this may be a missed opportunity to make progress in some areas of reform. Any programme introducing fundamental change should be carefully constructed and aimed at a coherent outcome taking into account the widest possible range of views and allowing sufficient time for consideration and response. The Government's approach to constitutional reform has been ad hoc and piecemeal. Reform must underpinned by a set of constitutional principles based on a proper understanding of the position and role of Parliament in relation to the other institutions of state. The report covers the Parliamentary Standards Bill, House of Lords reform, a written constitution, stronger powers to local government, electoral reform, young people's engagement with politics, freedom of information. The Committee cautions that inappropriate handling of bills and proposals for reform specifically designed to restore public trust may further undermine that trust.

Book excerpt: For years the public has become increasingly disillusioned and cynical about its governmental institutions. In the face of alarming problems-most notably the $400 billion budget deficit-the government seems deadlocked, reduced to partisan posturing and bickering, with the president and Congress blaming each other for failure. And neither party can be held accountable. The public tendency is to blame individual leaders- or politicians as a class-but an insistent and growing number of experienced statesmen and political scientists believe that much of the difficulty can be traced to the governmental structure itself, designed in the eighteenth century and essentially unchanged since then. Is that inherited constitutional system adequate to meet the challenges of the twenty-first century, or has the time come for fundamental change? Should we adopt an electoral system that encourages unified control of the presidency, the Senate and the House? Lengthen terms of office? Limit congressional terms? Abolish or modify the electoral college? Introduce a mechanism for calling special elections? Permit legislators to hold executive offices? Redistribute the balance of powers within the governmental system? In this revised edition of his highly acclaimed 1986 volume, James Sundquist reviews the origins and rationale of the constitutional structure and the current debate about whether reform is needed, then raises practical questions about what changes might work best if a consensus should emerge that the national government is too prone to stalemate to meet its responsibilities. Analyzing the main proposals advanced to adapt the Constitution to current conditions, he attempts to separate the workable ideas from the unworkable, the effective from the ineffective, the possibly feasible from the wholly infeasible, and finally arrives at a set of recommendations of his own.

Book excerpt: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

Book excerpt: Proposals for constitutional reform in the United Kingdom are examined critically. Ideas of governance' as posited by various accounts in the literature of politics are compared with the simpler idea of government' that is predicated within the reform programme. It is argued that changes in the site of public power, as well as in the reality of its exercise through a range of bodies beyond the traditional state, now provide a much more complex situation than the reform programme acknowledges. The paper calls for the development of a new technology of constitutional control to capture fugitive power. The paper concludes with a brief examination of some newer theories of radical or participatory democracy and their potential to assist in a wider project of constitutional renewal.

Book excerpt: In 2016, Sir Geoffrey Palmer and Andrew Butler proposed and published a written, codified constitution for Aotearoa New Zealand. Since then the authors have travelled the country, discussing with the public the nature of New Zealand's identity and where the country is headed. After considering their conversations and formal submissions, this second book - with its revised proposal for a codified constitution - is the product of a year in development. Towards Democratic Renewal reinforces Palmer and Butler's argument for a robust and democratic framework that will safeguard our political system against future challenges, from climate change to earthquakes, 'post-truth' politics and surveillance. This clear, revised constitution defines and entrenches government accountability and transparency, protects the rights of our peoples and tangata whenua, and offers transformative steps to uphold the sovereignty and integrity of Aotearoa New Zealand.

Available in PDF, EPUB and Kindle. Book excerpt: From the acclaimed author of Unfinished Business, a story of crisis and change that can help us find renewed honesty and purpose in our personal and political lives Like much of the world, America is deeply divided over identity, equality, and history. Renewal is Anne-Marie Slaughter’s candid and deeply personal account of how her own odyssey opened the door to an important new understanding of how we as individuals, organizations, and nations can move backward and forward at the same time, facing the past and embracing a new future. Weaving together personal stories and reflections with insights from the latest research in the social sciences, Slaughter recounts a difficult time of self‐examination and growth in the wake of a crisis that changed the way she lives, leads, and learns. She connects her experience to our national crisis of identity and values as the country looks into a four-hundred-year-old mirror and tries to confront and accept its full reflection. The promise of the Declaration of Independence has been hollow for so many for so long. That reckoning is the necessary first step toward renewal. The lessons here are not just for America. Slaughter shows how renewal is possible for anyone who is willing to see themselves with new eyes and embrace radical honesty, risk, resilience, interdependence, grace, and vision. Part personal journey, part manifesto, Renewal offers hope tempered by honesty and is essential reading for citizens, leaders, and the change makers of tomorrow.

Available in PDF, EPUB and Kindle. Book excerpt: Constitutional Amendments: Making, Breaking, and Changing Constitutions is both a roadmap for navigating the intellectual universe of constitutional amendments and a blueprint for building and improving the rules of constitutional change. Drawing from dozens of constitutions in every region of the world, this book blends theory with practice to answer two all-important questions: what is an amendment and how should constitutional designers structure the procedures of constitutional change? The first matters now more than ever. Reformers are exploiting the rules of constitutional amendment, testing the limits of legal constraint, undermining the norms of democratic government, and flouting the constitution as written to create entirely new constitutions that masquerade as ordinary amendments. The second question is central to the performance and endurance of constitutions. Constitutional designers today have virtually no resources to guide them in constructing the rules of amendment, and scholars do not have a clear portrait of the significance of amendment rules in the project of constitutionalism. This book shows that no part of a constitution is more important than the procedures we use change it. Amendment rules open a window into the soul of a constitution, exposing its deepest vulnerabilities and revealing its greatest strengths. The codification of amendment rules often at the end of the text proves that last is not always least.
