Book Synopsis A Constitution of Direct Democracy by : Michael N Mautner, Ph. D.
Download or read book A Constitution of Direct Democracy written by Michael N Mautner, Ph. D. and published by Legacy Books. This book was released on 2000-01-01 with total page 217 pages. Available in PDF, EPUB and Kindle. Book excerpt: All people share the basic needs of survival and the social drives embedded in human nature. Survival demands sustenance, safety and procreation; and the social drives demand dignity, justice and freedom. These shared values emerge when the common will is distilled from the diverse wills of people. Where this communal wisdom governs, human dignity will be honored and our survival will be secure. This book describes a system of pure democracy where all major decision are done through referendums and statistically meaningful public opinion polls. The policies are then executed by expert agencies with oversight from public policy panels. The book also describes transition to Direct Democracy through Representatives pledged to "I shall vote in Congress or Parliament according to the instructions of my constituents."

Book excerpt: How can the power of constitutional judges to overturn parliamentary choices on the basis of their own reading of the constitution, be reconciled with fundamental democratic principles which assign the supreme role in the political system to parliaments? This time-honoured question acquired a new significance when the post-commumst countries of Central and Eastern Europe, without exception, adopted constitutional models in which constitutional courts play a very significant role, at least in theory. Can we learn something about the relationship between democracy and constitutionalism in general, from the meteoric rise of constitutional tribunals in the post-communist countries? Can the discussions and controversies relating to constitutional review which have been going on for decades in more established democracies illuminate the sources of the strength of constitutional courts in Central and Eastern Europe? These questions lie at the center of this book, which focuses on the question of constitutional review in postcommunist states, from a theoretical and comparative perspective. The chapters contained in the book outline the conceptual framework for analyzing the sources, the role and the legitimacy of constitutional justice in a system of political democracy. From this perspective, it assesses the experience of constitutional justice in the West (where the model originated) and in Central and Eastern Europe, where the model has been implanted after the fail of Communism.

Book excerpt: The referendum is not a monolithic method of national decision making. There are a multitude of referendum forms which exist under varying constitutional conditions and operate in different ways. A global comparison shows that more than half the constitutions of the world provide for the referendum at a national level, but referendums are also carried out without explicit constitutional support. Two main forms of referendum can be observed, the mandatory constitutional referendum and the policy vote. This book argues that the referendum does not undermine representative decision making, but supplements it in various ways: the referendum is not diametrically opposed to representative government, and when properly designed and used, the institution of the referendum can enhance the legitimacy of a constitutional and political system. This book is the first comprehensive constitutional and comparative analysis of the referendum. It offers illuminating and intriguing reading for all those interested in national decision making.

Download or read book Sovereignty Referendums in International and Constitutional Law written by İlker Gökhan Şen and published by Springer. This book was released on 2015-01-28 with total page 303 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on sovereignty referendums, which have been used throughout different historical periods of democratization, decolonization, devolution, secession and state creation. Referendums on questions of sovereignty and self-determination have been a significant element of the international political and legal landscape since the French Revolution, and have been a central element in the resolution of territorial issues from the referendum in Avignon in 1791 until today. More recent examples include Quebec, East Timor, New Caledonia, Puerto Rico and South Sudan. The global aim of this book is to achieve a better empirical and legal understanding of sovereignty referendums and related problems in international and national law and politics. Accordingly, it presents readers a comprehensive study of sovereignty referendums from the perspectives of both international and constitutional law.
Book Synopsis Direct Democracy by : Thomas E. Cronin
Download or read book Direct Democracy written by Thomas E. Cronin and published by . This book was released on 1989 with total page 310 pages. Available in PDF, EPUB and Kindle. Book excerpt: Americans have grown increasingly restive when dissatisfied with legislation or elected officials between elections. As a result, public interest in and use of the devices created to give voters a greater direct voice in our democracy, referendum, recall, and initiative, have proliferated in recent years. Cronin has thoroughly examined the development of recall petitions, local initiatives, and referenda and interviewed those involved in the recent growth of the direct democracy movement. He finds that there are difficulties with direct democracy devices, yet he concludes that these procedures have been a lasting, and generally a positive, part of the American political landscape. - p. Book Synopsis The Limits and Legitimacy of Referendums by : Richard Albert
Download or read book The Limits and Legitimacy of Referendums written by Richard Albert and published by Oxford University Press. This book was released on 2022 with total page 321 pages. Available in PDF, EPUB and Kindle. Book excerpt: The possibility of democracy-enhancing uses and anti-democratic abuses of referendums reveals a paradox: mechanisms of democracy can be exploited to do violence to the basic principles of democracy. The Limits and Legitimacy of Referendums seeks to identify standards we might use to assess the democratic legitimacy of a referendum when we cannot rely on the norms of traditional liberal democracy. This innovative book explores how referendums manage the tension between liberalism and democracy, and whether this device holds promise for reconciling these two commitments. A range of scholars from around the world expose how referendums may be abused on one hand to achieve short-term political or even personal gains, and how, on the other, they may aspire to reflect the best traditions of deliberative, innovative, democracy-enhancing popular decision-making. Structured around three big questions, this book seeks to identify what makes a referendum legitimate. First, why have referendums on issues of fundamental political importance become so frequent around the world? Second, who are - or who should be - the people that make decisions about a political community's future? And third, are referendums an effective and reliable mechanism of popular sovereignty or democratic choice? These essays - written for scholars, public lawyers, political actors and citizens - bring together diverse perspectives on referendums, constitutionalism, liberalism and democracy in ways that challenge the conventional wisdom, prompt new answers to enduring questions, and urge reconsideration of how we evaluate the legitimacy of referendums.
Book Synopsis Constitutional Referendums by : Stephen Tierney
Download or read book Constitutional Referendums written by Stephen Tierney and published by OUP Oxford. This book was released on 2012-04-05 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: The use of referendums around the world has grown remarkably in the past thirty years and, in particular, referendums are today deployed more than ever in the settlement of constitutional questions, even in countries with little or no tradition of direct democracy. This is the first book by a constitutional theorist to address the implications of this development for constitutional democracy in a globalizing age, when many of the older certainties surrounding sovereignty and constitutional authority are coming under scrutiny. The book identifies four substantive constitutional processes where the referendum is regularly used today: the founding of new states; the creation or amendment of constitutions; the establishment of complex new models of sub-state autonomy, particularly in multinational states; and the transfer of sovereign powers from European states to the European Union. The book, as a study in constitutional theory, addresses the challenges this phenomenon poses not only for particular constitutional orders, which are typically structured around a representative model of democracy, but for constitutional theory more broadly. The main theoretical focus of the book is the relationship between the referendum and democracy. It addresses the standard criticisms which the referendum is subjected to by democratic theorists and deploys both civic republican theory and the recent turn in deliberative democracy to ask whether by good process-design the constitutional referendum is capable of facilitating the engagement of citizens in deliberative acts of constitution-making. With the referendum firmly established as a fixture of contemporary constitutionalism, the book addresses the key question for constitutional theorists and practitioners of how might its operation be made more democratic in age of constitutional transformation.

Download or read book Referendum Democracy written by M. Mendelsohn and published by Springer. This book was released on 2001-09-25 with total page 277 pages. Available in PDF, EPUB and Kindle. Book excerpt: As the referendum becomes a more regular component of decision making, it leaves few, if any, institutions, processes and values of democracy untouched. Political actors of all kinds - including political parties and interest groups - seek to use the referendum device to further their own objectives. The end result is a different kind of democracy than existed before. This book lays out the comparative research agenda on the impact of referendums on the practice of liberal democracy.
Book Synopsis The Constitution of Freedom by : András Sajó
Download or read book The Constitution of Freedom written by András Sajó and published by Oxford University Press. This book was released on 2017-11-04 with total page 450 pages. Available in PDF, EPUB and Kindle. Book excerpt: Constitutional democracy is more fragile and less 'natural' than autocracy. While this may sound surprising to complacent democrats, more and more people find autocracy attractive, because they were never forced to understand or imagine what despotism is. Generations who have lived in stable democracies with the promise that their enviable world will become the global 'normal' find government rule without constitutionalism difficult to conceive. It is difficult, but never too late, to see one's own constitutional system as something that is fragile, or up for grabs and in need of constant attention and care. In this book, András Sajó and Renáta Uitz explore how constitutionalism protects us and how it might be undone by its own means. Sajó and Uitz's intellectual history of the constitutional ideal is rich in contextual detail and informed by case studies that give an overview of both the theory and practice of constitutionalism worldwide. Classic constitutions are contrasted with twentieth-century and contemporary endeavours, and experimentations in checks and balances. Their endeavour is neither apologetic (and certainly not celebratory), nor purely defensive: this book demonstrates why constitutionalism should continue to matter. Between the rise of populist, anti-constitutional sentiment and the normalization of the apparatus of counter-terrorism, it is imperative that the political communities who seek to sustain democracy as freedom understand the importance of constitutionalism. This book is essential reading for students of law and general readers without prior knowledge of the field, as well as those in politics who believe they know how government works. It shows what is at stake in the debate on constitutionalism.

Book Synopsis Misinformation in Referenda by : Sandrine Baume
Download or read book Misinformation in Referenda written by Sandrine Baume and published by Routledge. This book was released on 2020-07-07 with total page 227 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book identifies the impact of misinformation in the context of referenda. While the notion of misinformation is at the centre of current events and is the subject of several studies, it has rarely been addressed in the context of referenda or from a multidisciplinary and comparative perspective. This book fills this gap. Different legal orders have been chosen because of their extensive referendum practices (California and Switzerland); a recent legislative process on the issue of misinformation (Germany, France, and Canada); or recent experience with a vote during which it was considered that false information had been disseminated (Brexit, Catalan independence, and Italian constitutional referendum of 2016). By bringing together authors from the political and legal sciences, the book focuses on combining the expertise of researchers from different backgrounds and origins in order to propose innovative solutions. In this regard, the book is characterized by the fact that it does not aim to combat misinformation per se, but develops suggestions meant to guarantee the conditions of formation of the political will during referenda. The book will be an invaluable resource for legal scholars, political scientists, and specialists of political communication. Outside the world of academia, the book may draw the attention of policy-makers, practitioners, and journalists confronted with the challenges of misinformation or disinformation.
