For Adams, the conflict with England was constitutional because there was no British Empire, only numerous territories including the American colonies not consolidated into a constitutional structure. Each had a unique relationship to the English. In two series of essays he rejected the Parliament’s claim to legislate for the internal governance of the American colonies. His Dissertation on the Canon and Feudal Law (1765) identified these claims with the Yoke, Norman tyranny over the defeated Saxons after 1066. Parliament was seeking to treat the colonists in similar fashion. The Novanglus essays (1774-75), traced the origin of the colonies, demonstrating that Parliament played no role in their establishment and so had no role in their internal governance without the colonists’ subsequent consent.

Political writers in the early modern period applied this idea to government in England, Venice, and Florence, and Americans used it in designing their constitution. In this history of political thought James Blythe investigates what happened to the concept of mixed constitution during the Middle Ages, when the work of the Greek historian Polybius, the source of many of the formal elements of early modern theory, was unknown in Latin. Although it is generally argued that Renaissance and early modern theories of mixed constitution derived from the revival of classical Polybian models, Blythe demonstrates the pervasiveness of such ideas in high and late medieval thought. The author traces medieval Aristotelian theories concerning the best form of government and concludes that most endorsed a limited monarchy sharing many features with the mixed constitution. He also shows that the major early modern ideas of mixed constitutionalism stemmed from medieval and Aristotelian thought, which partially explains the enthusiastic reception of Polybius in the sixteenth century. Maintenance, in the sense of intermeddling in another person's litigation, was a source of repeated complaint in medieval England. This book reveals for the first time what actually transpired in the resultant litigation. Extensive study of the primary sources shows that the statutes prohibiting maintenance did not achieve their objectives because legal proceedings were rarely brought against those targeted by the statutes: the great and the powerful. Illegal maintenance was less extensive than frequently asserted because medieval judges recognized a number of valid justifications for intermeddling in litigation. Further, the book casts doubt on the effectiveness of the statutory regulation of livery. This is a treasure trove for legal historians, literature scholars, lawyers, and academic libraries.
