Book excerpt: Business operations may have an adverse impact on the environment and on the livelihoods of the surrounding communities. For these relationships, often stretching over several generations, a governance structure and conflict resolution mechanisms are needed. Very general terms of reference for these can be found in the so-called Ruggie-Principles and in similar instruments. Many companies and states are now reviewing their conflict resolution mechanisms in the light of these standards for Corporate Social Responsibility (CSR). New mechanisms for dealing with grievances, dialogue and mediation are being set up. Increasingly, courts deal with such conflicts as well, which creates a demand for design of appropriate litigation procedures and case management. In this paper, we facilitate these processes by developing more concrete terms of reference for CSR conflict mechanisms (judicial or non-judicial). First, we list 20 types of issues that frequently cause conflicts and the characteristic interests of business and community members in these disputes. Then we analyze what is generally needed to solve these types of conflicts effectively, focusing on tasks, capabilities, timing and costs. We find that CSR creates many different conflict management needs, requiring a range of different capabilities. Most capabilities have to be available locally, but most of them have also to be linked to specialist services through internet or by bringing in expertise. Building conflict management capabilities thus requires substantial investments for companies, preferably at an early stage of setting up the operations. Once conflicts emerge, it is much more difficult (but not impossible) to bring in the credible and neutral third parties that are essential for conflict management. One reason for this is the ethical dilemma of funding of neutral interventions by the company once the situation has deteriorated.

Book excerpt: Within three individual essays, this thesis deals with collaborative and confrontational approaches by NPOs towards companies, and the role these play with respect to corporate responsibility. By drawing on social movement theory, nonprofit-business collaboration literature as well as legitimacy theory, it advances our knowledge regarding two topics: First, this thesis provides answers to the question how successful collaborative and confrontational approaches are individually at influencing households' judgements of companies and of NPOs themselves. Second, it extends our knowledge of interactions between these approaches. With respect to individual effects, this thesis demonstrates that both collaborative and confrontational approaches by NPOs exert a significant effect on households' legitimacy evaluations of companies and subsequently their consumption intentions. Legitimacy also appears as important underlying factor influencing households' support for NPOs, with collaborative NPOs enjoying higher legitimacy and thus support from households than confrontational ones. Concerning interactions between these two types of approaches, this thesis finds confirmation for previous suggestions that contrasting NPO approaches interplay - but demonstrates that such interactions clearly present a double-edged sword. By simultaneously focusing their approach on the same company, both types of NPO suffer a loss in their ability to influence households' perceptions of companies in the way they envision as well as their capability of attaining resources. However, if such approaches are applied sequentially, the picture of these interaction-effects become more positive. These results indicate that NPOs with different approaches towards companies are well advised to work together in a strategic manner in order to maximize their success.

On June 29, 2005 the court convicted and jailed five people for failing to comply with the order of the High Court restraining them from interfering with Shell's project. When Communities Confront Corporations examines the issues and events that led to the incarceration of the Rossport Five and how it resonates with events in the Niger Delta region of Nigeria. It argues that conflicts between communities and corporations, though pervasive, do not appear to receive adequate scholarly attention. The book compares the altercations between Shell and the Erris communities in Ireland and the responses to these conflicts, with similar conflicts generated in the Niger Delta area of Nigeria by the presence of the oil giant. It challenges the so-called conspiracy theory, which is often associated with the oil company's operations in the Niger Delta and argues that the key difference between the two sets of conflicts and responses to them is the context.
