The contributions provide a detailed review of democratic decay and the 'rule of law' impairment in many countries of the region. The book goes beyond mere observation and explores all the main theoretical elements that can lead to a more comprehensive understanding of the political and normative impact of the pandemic. In terms of constitutional design and concerning the actual behaviour of political bodies, the fairness and efficacy of Latin American state responses during the COVID-19 pandemic did not rely on civic culture, executive goodwill, or boldness on the part of the judges. The aim of this volume, therefore, is to unravel the most subtle elements of a very puzzling situation. Multidisciplinary perspectives are deployed to explore how democratic standards and goals have been reshaped by nuanced constructions of certain atavistic normative ideas or even by non-constitutional policies. The book sheds light on the underlying connection between politics and law.

Book excerpt: Few tasks are as crucial for the future of democracy in Latin America—and, indeed, in other underdeveloped areas of the world—as strengthening the rule of law and reforming the system of taxation. In this book, Marcelo Bergman shows how success in getting citizens to pay their taxes is related intimately to the social norms that undergird the rule of law. The threat of legal sanctions is itself insufficient to motivate compliance, he argues. That kind of deterrence works best when citizens already have other reasons to want to comply, based on their beliefs about what is fair and about how their fellow citizens are behaving. The problem of "free riding," which arises when cheaters can count on enough suckers to pay their taxes so they can avoid doing so and still benefit from the government’s supply of public goods, cannot be reversed just by stringent law, because the success of governmental enforcement ultimately depends on the social equilibrium that predominates in each country. Culture and state effectiveness are inherently linked. Using a wealth of new data drawn from his own multidimensional research involving game theory, statistical models, surveys, and simulations, Bergman compares Argentina and Chile to show how, in two societies that otherwise share much in common, the differing traditions of rule of law explain why so many citizens evade paying taxes in Argentina—and why, in Chile, most citizens comply with the law. In the concluding chapter, he draws implications for public policy from the empirical findings and generalizes his argument to other societies in Africa, Asia, and Eastern Europe.

En El Salvador y en Colombia, aunque se celebraron en tiempos distintos, ambos tipos de comicios se consideran en el mismo capítulo; allí, las presidenciales precedieron a las legislativas con un año de diferencia en el primer país y las legislativas antecedieron por tres meses a las presidenciales en el segundo. Se recogen también en capítulos independientes las elecciones únicamente legislativas de México y Venezuela. Si bien el criterio temporal siempre puede calificarse de caprichoso en este caso sigue la preocupación iniciada hace ocho años de dar cumplida cuenta del acontecer electoral en la región, en el ámbito de los dos poderes representativos del Estado por excelencia. En efecto, este volumen da continuidad a anteriores trabajos. El bienio aquí analizado da cabida a un nivel promedio de elecciones presidenciales, si se tiene en cuenta el acumulado en la región desde hace 30 años, por lo cual es representativo del quehacer político latinoamericano. Así, la Tabla 1 recoge las 117 elecciones presidenciales que se han llevado a cabo en la región entre 19861 y 2015 cuyo resultado no fue cuestionado; su media es de cuatro procesos electorales por año y aquí el número de elecciones que se recogen son nueve.

Caudillos and clans often use informal political practices—ranging from clientelism and patronage to harassment of political opposition—to control local political dynamics. These arbitrary and, at times, abusive practices pose important challenges to how Latin American democracy works and how power is exercised after the decentralization reforms in the region. These reforms promised to bring the government closer to the people and to promote popular participation. In many cases, these ideals are unmet, and newly empowered local politicians have been able to turn municipalities into personal fiefdoms. This book explores how local caudillos stay in power and why some are more successful than others in retaining office. Tomáš Došek provides an in-depth analysis of six cases from Chile, Paraguay, and Peru to show the strategies that caudillos pursue to secure power and the mistakes they commit that drive them out.
